All you hardworking folks please read for your benefit!
1996 Southern Lifestyle Homes, sold doublewide to William before we married in 1997, signing on loan application; but received only sales transfer carbon with figures not correct and wasn't signed by officer of business. Bill never received a copy of contract nor title which was applied for by business but not showing title owner of William nor lien holder. Bill was ill and on death bed in 1998. I took over finances and paperwork and found all recently when received very unkind letter of foreclosure because ill husband fell behind--had to go self-employed after illness which took all our time to try getting on feet with with some folks paying when they felt like it.

I requested copy of mortgage and pay-off amount three times, through Vanderbilt Mortgage and Finance/Clayton.net using the "contact us" on their website--vmf.com Received no copy nor pay-off. Faxed copy to them using Fax:1-865-380-3750 on website. Received no reply....Faxed: 1-336-232-7706 at top of the letter sent to us.....my printer showed it was Oakwood fax--still no reply.

I went on Clayton Homes and saw Mortgage Calculator...it showed that the home is covered in the monthly payment---Our copy of sales transaction showed insurance was included! Yet, Vanderbild asked us to either get our own insurance (when they were assigned to our account) or they would put extremely high insurance on it and charge us. We put our own insurance on our home. Now, think about it---doesn't that sound like if it is charged to us through the monthly payment and we had to get our own insurance....that if anything had happened to our home, that Vanderbilt and Oakwood would collect on the two policies? It sure looks like it from what figures I do have since Oakwood ? or Vanderbilt ? would be lien holders through the monthly payment...and they would be lien holders on the policy we hold to cover our doublewide.

Yes, I am upset...no copy of contract, no copy of title and they would get double payment if something happened to our home. Ladies and/or gentlemen (I am sure most of you are in the same boat because of how others take advantage of our efforts) please read all paperwork whether home, car, or other major purchase before signing...take your time. My husband was ill...still not feeling the best.

I truly feel the companies in my "rip-off" report need to be extensively investigated---all of them. Saying nothing about all the harassment we have endured!

11-14-06 ADDITIONAL COMMENTS!! ---

Folks, if you need help, read what we have been going through so that if you haven't gotten to the state we are in, that you will be able to avoid this.

I finally,on the 10th of Nov. after not receiving faxed paperwork from Vanderbilt Mortgage & Finance; wrote through their website that WE CONSIDERED OURSELVES TO BE IN DISPUTE MODE WITH THEM, FOR them to stop harassing us with phone calls, etc; until we received the copies of the papers we requested.

To this, we were immediately bombarded with phone calls. The next morning, they called us 5 times from 8:07 AM to 8:15 AM. They continued all Sat. and Sun. (At times we cut the phone off) On Monday at 12:14 PM through 12:15 PM, we finally got the fax of 7 pages from Vanderbilt.

There were two warnings which would lead one not understanding them, to think the paperwork COULD NOT BE SHARED WITH ANYONE. I hope you folks who do have your own paperwork realize you have the right to share your own paperwork with whom ever you please!

The paperwork was all tampered with, headers were cut off, only parts of pages were sent. Lcked several pages of insurance. Got only first half of page 1, with only last (right side) of last page of loan agreement. They had probably made a copy, they with white-out took out much of the pertient information like signatures,dates, etc. They must have blurred the papers before copying. Then they must have copied that paper after blurring it so that except for the first three sheets of 7pages, we could NOT READ THEN EVEN WITH SCANNING AND ENLARGING. I PRINTED THAT OFF AND STILL COULD NOT READ WITH GLASSES AND A MAGNFYING GLASS. NOW WHAT DO YOU ALL MAKE OF THAT?

NEXT I checked out the insurance. Remember Mike I had questioned two policies? Well, Once we purchased our own home insurance way back when, our mortgage monthly payment did not reflect that. So I was sure we were still paying for insurance that they carried.

WELL "dumb me" studied paperwork and they had obtained LIFE INSURANCE ON MY HUSBAND!!! CAN YOU BELIEVE THAT? And since husband had not paid the ins. on time, they started the new policy in 7-06 and charged over $1200.00 for policy - LOOKS TO ME LIKE THEY SWITCHED PAPERWORK OF EARLY POLICY WITH SAME COMPANY. American Modern Insurance, Group, now holding Home Insurance.(our monthly payment covering that) and AMERICAN BANKERS INSURANCE COMPANY OF FLORIDA. WORKING WITH HOMEFIRST AGENCY, INC of Maryville, TN is now handling the LIFE INSURANCE ON MY HUSBAND. That Vanderbilt has now charged us with as of July, 2006. I PERSONALLY, did not know that that could be possible but with much studying with magnifying glass, that seems to be what has happened.

THE OTHER ISSUE I HAVE WITH THIS, IS that they are charging what looks like 28%interent on the insurance part of the loan. Wheither by the year or the 30 years, I need to have that checked out.

IN A NUT SHELL, VANDERBILT MORTGAGE & FINANCE (Vanderbilt Mortgage is not included with the group above. IT'S SEPARATE FROM THEM! PLEASE KEEP THIS IN MIND); THE ABOVE GROUP ARE NOT TREATING PEOPLE JUSTLY. One group started in 1966. VMF started 1974, haven't checked it out yet about the rest.

PLEASE, PLEASE, PLEASE. STUDY ALL of your paperwork. You should be able to see where paperwork has been tampered with! You should be able to have copies of all you need involving these companies; you should be able to get "free first councel from a lawyer to help you know what is going on". CAN YOU IMAGINE HOW MANY FOLKS HAVE BEEN STUNG BY THESE PEOPLE OVER THE YEARS? The copies I have are worthless. I have no way of being to read them. The PAY-OFF AMOUNT was over a thousand dollars--plus what it was in 2004. and the statement that is in the paper faxed from "pay-off department" states as follows:
"The pay-off amount is reflects amount until 12/13/06. Then from 12/13/06 until 12/29/2006,the payoff increases $12.60 per day until it is paid to them. AND THEN, AFTER THEY GET THEIR MONEY. THE LOAN DOCUMENTS AND/OR TITLE WILL BE MAILED TO YOU WITHIN 6 WEEKS.

After, and of the dealings done to all of us, so far. WHO ON EARTH WOULD TURN OVER THE PAY-OFF AND THEN WAIT UP TO 6 WEEKS FOR THE PAPERS THAT ARE RIGHTLY OURS?

MAY GOD BLESS ALL THOSE TRYING TO LIVE A JUST AND MEANINGFUL LIFE FOR GOD, and trying to make a decent living for those arould them and others who need help. "We are our brothers'and sisters' keeper. THESE COMPANIES AND THEIR FRUIT DO NOT SHOW THAT.

Really read over your papers and BE SURE TO SAVE THEM! It is my understanding that "mortgage fraud" "insurance fraud" is a feleny and THERE IS NO STATUTE OF LIMITATIONS on such corruption.
Be sure to check your paperwork to see if insurance is figured into your loan. Ours was according to the paper I have....means we paid interest on that money that would go to pay the insurance policy taken out according to the paper on a monthly basis. Then Vanderbilt Mortgage and Finance recently tried to get us to pay another $130.00 per month for "their insurance". What would that tell you?....Of course, husband said no...it was way too high. Our paper stated $1054. for ins. the first year..got policy for that one. But then in 1999, (would have to verify) we had to get "our own insurance". Well paid for that, plus still paying the same amount for the monthly payment.

We all know that since we do not deal that way day in and day out, we would not consider that fact, now would we?

I have asked Vanderbilt Mortgage and Finance at least 5 times through their web site "contact us" to fax us the copies of the paperwork we have a right to, plus the pay-off amount. Each time I would get the automail--having clayton.net on it stating that they would get back within 2 business days. Started Oct. 19th, 2006...also used the two fax numbers the one in their web site and fax on paper (letter) letterhead they sent certified. that fax number showed on my ID of printer the name "Oakwood".. ..what does that tell you? Still no reply...not even stating sorry could not fill request. They put a paragraph at bottom of the email form stating that if not the person who is asking...........trying to scare one that would not understand the privacy act. I have found out about several other items to be covered to get this straight. I sent a 6th email through their web site Friday night the 10th stating that because they have not faxed the paperwork copies which are rightfully ours, that we considered that we are in dispute stage until we get the paperwork and until this is justly corrected. I also stated that they stop the harassing phone calls. we recognize the numbers of some...and those numbers ring one phone and then the other....or they use two numbers and call both of our numbers at once. This goes on several times a day...unless I cut the phone off. I must request that anyone needing to call me call before 8:00 am and after 9:00 pm....and we are trying to run a business since Bill was ill--never fully recovered--we are trying to make a living so as not to rely on the government or others for help. Oakwood knew and Vanderbilt knew when they claimed they had right to collect our payments. If I do happen to have phone connected, anyone would need to be sure their number or business is in the ID and the number so I would answer.

Our friends and family know all about this matter and they are more than willing to inconvenience themselves for us.

Do hope this helps you all who read this.....I know it isn't easy for you either, but you must not give up...check out ahead of time, the web sites of those above...check their map and list of "used and repo homes". If they sold and took homes illigally which it sounds like they have done...(Clayton Homes has been in business since 1966...."gives to charity, too!) It takes time to check web sites out....but each one in their grips needs to do that, before it's too late.

REMEMBER MORTGAGE FRAUD . IT IS A FELENY WITH NO STATUTE OF LIMITATIONS (FEDERAL LAW ISSUE)..may be wrong spelling in this.....been up since 3:00 am trying to do what I have suggested that you all do above. Prove things for yourself, please.

Will try to get back after get next mission accomplished that I need to do with this.........

As I recall things that might help, I will try to update for all of you..

I was reading about Oakwood Acceptance Bankruptcy on one of these reports. One might need to keep in mind that even tho one of the group uses bankruptcy as a way "out", it does not mean that they are not hiding under a dirt pile of the others in the group. This group according to their web site vmf, for one, have been in business since the 1970's so they are very good at what they do. Can you imagine how many folks in yours and my situation have probably been ripped off? They have learned to work "the system" for their benefit.

Folks who are trying to live right and make a decent living would never "intentionally" harm others in such a way as these companies have. One can be mislead into believing that what these companies are doing in written "in stone". Not so.

Mortgages are mortgages (loans) no matter what the loan is taken out on. If you go to Vanderbilt Mortgage. They handle house loans it looks like, however, next fill in your state and other information, go to page 2. If you read page 2, you will see a report on vmf complains against vmf to BBB. Now go to page 3 for a full name--Mortgage Fraud Center and full address of a group that is to handle Mortgage Fraud. Report your problem.

Hopefully, this will help many of you! I hate seeing "Big Wigs" destroying folks like you and me. This represents a huge number of folks in the same "ship"; note that I state ship and not "boat".

Do take care of yourselves and if enough act on the above, maybe with God's help, something will be done to change or balance the scales for us.

Thanks for your note. Do you mean "there should not be two overlapping insurance policies.."? Would our insurance company be able to check if our serial number is insured by another company?

How would be the best way to find out? I know by the paper we have that we were charged a huge amount and it was added into the amount that was used to figure out our monthly payment. Maybe that is one reason why the companies of Oakwood and Vanderbilt will not fax us a copy of our loan contract with them.

Double insurance...

There cannot be two or more overlapping insurance policies on the same property. No one ever gets paid double in case of a loss. One of the insurance companies must give you a refund for the premiums paid during the time it was already covered by another policy.
