To Whom it May Concern:

The following is the final email I sent to Vending Dreams. I received no response.

Hi Chris,

I did not hear back from you and Jim Ellis as promised after we spoke on Wednesday night, nor did I hear from you Thursday or today. I have not been able to get through to Vending Dreams on any of the five numbers I have, and no emails, messages, or pages have been returned from anybody in more than 48 hours.

The down payment check was sent on 9/20/2005, received by your company on 9/22/2005, and cashed on 9/26/2005. I was verbally promised (by you) placement of my first machine within 10 days of receipt of my down payment. I have checked with other locators who guarantee placement within a similar time frame or a full refund.

This is my final attempt to contact someone at Vending Dreams. Per the second clause in our contract, I would like a check sent to me refunding 100% of my down payment.

The second clause in the contract I signed with Vending Dreams states:

"In the event that the Locator is unable to secure the locations through the exclusive fault or negligence of the Locator and not resulting in part and/or from cancellation of the above named, the deposit paid by the Company to Vending Dreams shall be refunded less any locations utilized."

I was sold the "White Glove" service, including assembly of six vending machines and shipping after locating them. It has been communicated to me by their Quality Control that they usually deal with gumball machines and not full size (650lb.+) soda machines. I believe that I was sold a service that Vending Dreams cannot deliver on.

I have talked with a receptionist, "Stacy", "Ashley", and Chris Oehler. I was not allowed to talk to the QC Manager "Susan", and my calls to the Jim Ellis, CEO were not returned.

My calls to the following numbers are no longer answered or returned: 618-592-6420, 618-592-6048, 618-592-6338, 618-554-2811 (Jim Ellis), 678-457-7581 (Chris Oehler).

Per our contract, I am seeking a full refund of my $1,066.47 deposit.

I spoke to someone that I deal with who has been in the business for a long while. I was told this company will be out of business maybe in 2006.

Since vending dreams and the other scumbag companies try do what they want they will all lose. Follow me!

I will be the next big thing in the Phila area.

You fell for it.

You don't sign a contract b/c these companies don't do what the contract says. And you had to put out over $1500. thats bullshit dude. your never going to see that money any time soon. I agree with you breach of contract but you fell for it. The vending business is awesome to get into once you know how the process works but as far as these jackasses your not getting it back. I'll tell ya they will find so many excuses. Pay people $50 per location and I'll guarantee you will find them. You should place them yourself b/c you know the area.

I made a phone call to these losers back in the earlier part of the year. Once that money goes to them see ya. Thats why people fail in this business.

Open Letter to Mr. Jim Ellis, President Vending Dreams

Mr. Ellis,

My name is Joshua A. Bevan, I am the President of Brahma Vending Inc. (you have my address and phone number on file, and I'm quite sure you recognize my name). I paid a down payment of $1,066.47 for a contract you did not deliver on. I attempted to contact the five phone number I have for your office (including your cell phone and Mr. Chris Oehler's cell phone) repeatedly and you eventually blocked my calls.

I have documented our interactions with your company and have filed a formal complaint with the Better Business Bureau, the Attorney General of Illinois, and the Attorney General of North Carolina. You should be receiving a letter from my attorney, Harry Crow, this week. We have also retained counsel in Illinois to pursue legal action in your own state, you will hear from attorney Ian Brenson shortly.

As it has been communicated to you, I am seeking a full refund of my down payment.
