VENTANA GROUP LLC Michael Hom Record of Court Judgments for Fraud, Unjust Enrichment, Alter Ego Foster City California

Michael Hom Personally and his company Ventana Group LLC have court issued judgments against them. They are recorded in the county recorders and court recorders websites. they are public records.

We were independent contractors under a formal contract with Ventana Group LLC. The agreement and terms of the contract detailed fee splits which Michael Hom and his company Ventana Group LLC willingly failed to honor. When we recognized that they were breaching the agreement, we notified them in writing via letter, and email.

We did receive a somewhat odd response that it would take a few months, but that clearly was in violation of the terms of the agreement which called for 7-10 business days.

 We pointed out the issue was the reconciliation of fee splits per our contract and provided them with our numbers showing a discrepancy between actual monetary remuneration per the contract and what was actually deposited to our accounts, and that’s when they began in earnest trying to stall and deflect. We received nothing but excuses from Mike Hom. Always something,  like all the records are being reviewed, our accountants on vacation,  our bookkeeper is out sick this week, then it was we changed accountants, and other excuses each time we contacted them, this went on for over 6 months of repeated requests for the accounting records on fees collected from multi-million dollar business transactions, as our records indicated that a large sum of money, which represented our portion of the fees collected under term of the contract was not deposited to our accounts.

 We finally were told that they received a withholding notice from the IRS. Mike Hom then emailed a statement showing more than $30,000.00 dollars they withheld and forwarded to the IRS.

 This was a willful and completely false representation of fact and we contacted our accountant and gave Power of attorney to access our IRS records, sure enough no withholding notice ever sent to Hom and Ventana Group LLC and no money that was claimed withheld was ever sent to the IRS on our account by Hom or Ventana Group LLC.

 We engaged counsel to draft a demand letter that they provide the full accounting within 10 days and to show proof of payments to IRS. No response to our demand was ever received by us or our counsel, Mike Hom, the Managing Director and Owner of Ventana Group, ignored emails and ignored voice mail messages and all attempts at communicating.

 We filed a lawsuit listing several causes of action. Now these are not some frivolous issues but rather serious breach charges, including fraud, unjust enrichment, and alter ego to which the Michael Hom made no response at all to the charges and no counsel contact was provided. On the day of Hearing no one showed up in court for Ventana Group LLC or for Michael Hom whom was also personally named as Defendant / Respondent to the court action. They ignored the court and failed to respond in any form whatsoever. We were awarded a judgement Jointly and Severally against Michael Hom and Ventana Group LLC of Foster City California, of over $ 111,000.00 U.S. dollars, By the Court.  30 days later the court ratified the judgment, there was no appeal filed. The counts listed in the Judgement as adjudicated in State Superior Court.  Fraud, Unjust Enrichment, Alter-Ego. This Judgment has been recognized in Hawaii Courts, And also the San Mateo County Courts and Alameda County Courts in California.   Michael Hom has not answered to any one of the 3 court actions either personally or by representative counsel.  

Mike Hom acted with malice aforethought to steal over 100,000 dollars, and willfully ignored, lied, and avoided any form of attempted communication and failed to provide the accounting, He also ignored all court orders and subpoenas, even when the courthouse was only 7 minutes and less than 5 miles away from the Ventana headquarters and his offices.  

It turns out, in the course of our reviews and research through our legal counsel we discovered that the company that Michael Hom was parading as a business entity had previously dissolved and that fact had to have been known to the principals as the filing records define several attempts to reinstate the entity, each of which ended in apparent failure according to the State Dept of corporations records regrading Ventana Group LLC and its Manager Michael Hom.

All the court records are accessible to the public online via the county courts websites. Nothing in this letter is private information as it is presently within the public domains of record including the world wide web which provides global reach.  

A certified copy of the court judgment, redacting my personal name, as I the suit was filed. Is also attached to, and made part of the complaint in evidence supporting our position that Michael Hom and his Company are of unsavory character and one should be very, very, skeptical when doing business with the likes of Ventana Group LLC and Michael Hom.
