Viceroy Homes Non disclosure of non refundable deposit Fife, Wa. Ontario, Canada home office

In the year 2000, y wife and I had planned to move to a more rural area of Washington State. We purchased propery, and were planning the transition to a slower pace of life. We had seen Viceroy advertised in a number of publications. We drove to the Fife office and looked into what they had to offer. We liked what we saw.

This is where the problems started. The salesman stressed we put money down on a "package" to lock in the lumber prices for 12 months. He stressed that they were due to increase soon. We wrote a check for $5000.00, which I feel was his commission. Well the market tanked soon after and we were unable to follow our plans. Other than meeting the salesman, Viceroy did nothing for us, no design work, nothing!

When we contacted them about a refund, we were told we had signed a contract with a no refund clause. I went thru the paperwork and a page with the clause was not to be found.

When I asked them for a copy of that page with my signature, or even my initials on it, they sent a copy with neither on it, just a rubber stamp of the date processed. As part of a contract, each page should have an initial on it to proove it was received, and reviewed. The short contract did not have
page numbers on them either.

This is a blatent case of non disclosure, crafted by the salesman and/or sales department. I would never deal with this company in the future. I will most likely have to spend more than the $5,000 to legally persue this matter.
