Virginia Department Child Support Enforcement practices do not take entire income into consideration. When my divorce was finalized it was stated an additional $300 a month was to be taken for arrearages of child and spousal support (Yes they can collect spousal support if you have an existing child support order with them.) The first month they did not collect spousal support AT all after sending their paperwork to my employer their oversight NOT mine (afterall they are the ones sending and enforcing the order.) They send a new order accounting for both spousal and child support which allows my employer to garnish my wages which is fine. They then send me a letter stating they will attach an additional $137 to the order for additional support owed. I called them advised them that they had a copy of the court documents stating they could not take anything additional other than the $300 stated in the court documents. The case worker was NOT happy about being advised it was in the court documents SHE had a copy of and insisted she was still going to take the additional money out. I had to call her supervisor and advise her supervisor that in the court documents it states that they could not take an additional $137 only the $300. The supervisor then got very angry and stated to me that they could and would do what was necessarty to get the money owed and they would garnish more wages. I asked for their attorney of files information so my attorney could speak to him and straighten this entire situation out and I was quite sure there would be a court date with her and the underling involved to sanction their child support office. That was straightened around and the $300 has been taken out. I then get a letter stating they are going to garnish my income tax due to arrearages WHEN they already have a payment plan set into place. 

 Now on to the other information. The "Person" handling my case when I call and try to speak with her is always very rude states what they are going to do for the mother. My rights as a father are not protected to be able to survive on my income. They did not take into account the fact I have a wife and another child that I am supposed to be able to support NOR the fact that I also provide for this childs medical expenses including healthcare coverage. Virginia Department of Child Support protects the women who REFUSE to work even though they are completely capable of doing so and go after the father. When the roles are reversed and the mother pays child support I have seen cases that have gone on for YEARS where the female gets away with things the male DOES NOT. I would say at this point a different branch of government needs to step up and make this an equality issue. 

 When you have a state boasting about "How Much They Have Collected" Then I think you need to absolutely reevaluate your branch of government. They need to step up to the plate and also make sure that ALL children are factored in when doing child support not just the one for the order. My child with my ex wife and my child with my NEW wife. As Virginia has also pointed out their math is NOT flawed. If their math is NOT flawed then please tell me how with Child Support and Spousal Support both being paid I am bringing home less than $300 a MONTH after taxes and she is walking away with over $1200 a month and she makes $567 a month on Disability without having to work and she doesn't even allow the SSI office to know she gets spousal support!!!
