I am seeking national information from other consumers regarding potential consumer fraud through the direct actions of Wachovia Dealer Services (Wachovia Financial Services/WFS formally known) and including but not limited to Wachovia Dealer Services strategic partnership with Balboa Insurance Group; a subsidiary corporation of Countrywide Financial Services (CFS-NSE). The purpose of this consumer inquiry is to question the possibility of a national class action law suit regarding potential consumer protection violations with reportedly known aforementioned public companies and any or all yet unknown or potential investment companies associated with the initial possible corporations, company's and associations hereto yet proven.

I am a consumer and did open an auto loan with Wachovia Dealer Services in 2007. Prior to accepting the new automobile, financed through WDS/WFS, we documented and provided full disclosure of a million dollar plus auto insurance policy which fully covers the said vehicle. Faxed copies, certified mail copies, and regular mail copies were subsequently directly administered to and received by Wachovia Dealer Services via fax, mail and agent confirmation telephone contact as requested through WDS; as well as Balboa Insurance Group via the Balboa Ins Group public fax number, website address included on correspondences from WDS (ihaveinsurance.com) and certified mailed copy of full covereage sent to WDS and BIG's company provided contact information.

We documented numerous phone contacts with BIG and WDS confirming auto insurance coverage over the course of approximately 4 months. We have thoroughly documented all contact with BIG and WDS as have our Insurance Agency and policy holder provider agency.

We have been assured by WDS via customer service rep "Bill" and customer service supervisor "Nick" in the California based office of WDS (800-289-8004) that the error on the fully responsible part of WDS via Balboa Ins would be rectified and the fraudulent attempt to continue to charge my loan account for proven unnecessary auto insurance charges (including but not limited to additional late fees, collection fees, etc) would be credited.

To date, WDS has continued to harass me via my employer and employee work related contacts; namely the customer service rep "Angel." Angel has been repeatedly informed of the WDS error and the service appointment of his supervisor "Nick." "Angel" has received clear directions to not contact my employer and my employer's main corporation office-Angel's continued actions are directly causing numerous harms and damages to be disclosed.

My auto loan payments have been declined by WDS or held pending late (etc)due to the additional Balboa Insurance charges arbitrarily and incorrectly assigned to my auto loan account. These "supposed" late payments have negatively impacted my credit. Currently the Dec 2007 payment is also being declined by WDS and additional late charges accrued without warrant.

Wachovia Dealer Services and Balboa Insurance Group ( BIG publicaly reported as owned by Countrywide Financial Services) are theoretically only permitted to cause damage to consumers through lack of unified consumer action and poor representation.

If you are a consumer and you have a well documented complaint with the aforementioned company's please publicly respond to this posting. I am not an attorney nor do I represent one. I am a consumer; one who will not tolerate fraudulent damaging actions taken against me.

I am posting this solely to inquire about the potential advocacy of initiating a class action investigation from consumer peers. I am also interested in well documented evidence of WDS and BIG's financial profits obtained through similar practices taken against other unsuspecting consumer's and any personal damage directly caused by the WDS and BIG's collection practices, arbitrary assignments of auto insurance, and consumer protection violations; including any consumer reporting actions taken with local state attorney general offices.

How is it that all of these posts date back so far and these businesses are still at it? Is this site that effective afterall? I am not too sure now! I am still looking for my post to appear at all. Newspapers are a good source for connections. I am in So. California. We are supposed to be ahead of the curve out here. I really think we are just bigger bait for the big fish. I hope these big corporations fall real soon! They have been preying on us middle Americans long enough! The credit reporting agencies REALLY need to go down! We need to stop buying credit reports and even worrying about them at all. Use cash and force that bunch of crooks to go belly up. It is a lot like the Emperor's Clothes. They have us thinking that this credit thing is the only way to live life as a real person in our society. That we are no worthy unless we run to them and buy a vehicle for a ridiculous and unrealistic amount of money, get excessive payments and then thank them for the opportunity to be ripped off! We drive off a lot in a car that has lost all of its value and warranties like a time bomb that just went off. We need to stop being brainwashed and start living our lives without their ball and chain programming.If we get out from underneath their credit mind game thumb, we could really smile as they go get in the long unemployments lines, and cut up their own credit cards and watch their own credit scores go down like the Titanic. If they could get some of their own medicine that would make all the crap we are forced to go through now, all completely worth it! There is no bailout for us, so why should they stay afloat? I will be paying attention to the media for signs of a lawsuit with any of the companies that have negligently contributed to my own current situation. I trust many will do the same. United we'll stand.

Wachovia has hired a bunch of scammers for their collections department. They need to be stopped. We paid our account faithfully even after my daughter lost her job. She went without food to pay them and all they did (BJORN) is lie to her. When her car was stolen and found stripped and burned, all they had to do was send the insurance company the payment records so that the insurance claims could be settled and they could be paid the 8000.00 she owed that was in sept 2008 they still have not sent that paperwork, what they did instead is lie and claim they respossed the truck indec 2008 created a false sale of the repossed truck and then sold her debt to a collections agency. So we want to join the law suit or have some one give us legal advice how to go after them

Wachovia claims to have repossed my daughters truck in December 2008 that was stolen and completely destroyed in sept 29,2008, they drug their feet instead of sending state farm(another situation) the payment records for the truck and that has caused delays..it still has not been settled. wachovia then tacked on 3000.00 extra dollars to the debt of 8000.00 and sold it to a collection agency. I do not have a lawyer but am looking for some help.

I read your comment and found over 300 hundred complaints that are similar to yours and mine.

I am prepared and in the process of making a decision on a law firm that will aggressively pursue this case.

Let's communicate A.S.A.P. and move on this. A year ago a case such as ours would have been a tough sell to a law firm that gets the kind of results we are looking for.

Now banks such as Wachovia Dealer Services formerly WFS are getting exposed for their fraudulent activity and there are politicians both at the state and national level that will help get our story and case heard.

My background is in finance and I have extensive experience in litigation. I understand what to look for in terms of exposing Wachovia's fraudulent activity and how to present the information to an attorney specializing in these matters.

Winning the lawsuit is not the issue; it's having a law firm behind us that is passionate and confident to take on a company the size of Wachovia.

Please get in touch, not sure how that's done without leaving name, phone, email etc. Let me know?

Please go to the following links and read, I am so very sorry for the unedited discourse written since most of the that which is contained in what you will see was written generally during the early hours in the morning. I am the original blogger for this page on WFS. Also please be aware that WFS after my pages went up and I sent the OTS, FTC, the California DOI after WFS they started with monitoring the site with employees posting disparaging remarks.

Here is a Law firm of whcih I requested to be apart of the Class action. Please recall the this was 2005 just after the passage of the 2004 Bankruptcy reform act which took all of the regulatories enforcement powers aways under the Commander and theif administration. As a result when I filed my complaints repetively all the agencies did was send all of my documentation to WFS and "simply ask them" "Are these assertions true" WFS in kind would respond No We did not do this and that was the end of the investigation. I pulled all stops on this and sent them to 10 agencied including reporting them to comsumer affairs and govenmental officals. the state of Californoa of which I work took the posture of "we will prosecute but you must collectively file complaints" here is the law firmm that initiated the law suite under Bill Lann Lee, who now serves in the DOJ I think on the Federal level.

this site will not permit contact, it is a legal issue for the site and those posting, you must get clever. Like I proposed some time ago however I got no response.

Designate a specific day and a specific time and then on that day everyone go to the DOJ Office and file a complaint or agree to meet at the department of insurance at a given time and date where an Identifier like a blue shirt blouse
they if some one brings a laptop draft a preliminary complaint right on the spot. Make PDFS of the complaints on this page and use them as evidence of all the victims all over the US as supportive evidence tot he assertions.

this is an insurance issue there fore you can complain to the state of California's DOI (Department of Insurance).

I am assuming you are in the state of california, if not organize and make it an effort across the country. this is happing to all of us from NY to Florida to California, Arizon, Ohio and on.

force the DOJ or DOI to make a list of those filing the complaints obtain those list if need be file and demand un the FOIA (Freedom of Information Act) then mobilize and contact all and unit to file the suit. Contact the law firm Lieff Cabraser Heimann & Bernstein and have tome to make a list.

When I was at war with them it was oly me so I was pushed aside. Be very mindful that these post are being watched and they are reporting back to Wachovia/WFS.

I am also a victim of corporate fraud perpetrated by WFS Financial, Wachovia Dealer Services. There has never been a better time than now to take action against them and seek damages, federal and state regulators are all over Wachovia looking for fraud. Contact me ASAP.

I will provide you with my name and specific information regarding the case when we can communicate privately.

It's been eight months since I presented my case to several attorneys and three offered contracts on contingency. I decided to hold off, let some time pass it was right after my business with Wachovia Dealer Services aka WFS Financial concluded and I was so angry I could not think clearly. I have experience in litigation the case had much more to offer and there were hundreds if not thousands of people that have been victimized. I felt I was rushing and I had time on my side with the current economic environment exposing Wachovia without anyone doing much of anything.

I have been doing research and gathering documentation to support my allegations. I have found a white knight in the media industry that will expose Wachovia, other than A.G. Edwards the remaining companies bought out over the last three to five years have blown up exposing fraud or ignorance, Westcorp will be the icing on the cake except this time they will not be able to claim stupidity. The evidence is strong chances are the federal regulatory agency I am handing over my information too will have no choice but to take action and file a formal investigation.

Although our cases are different each are a piece to the puzzle.

Hi Molly,

In reading reports, I had noticed that email addresses sometimes are included in posts. I filed a post the other day with my email address in it but, I see they didn't post it. I thought maybe it could "slip" by. :-)

I am an attorney and I am interested in hearing more information. However, there doesn't seem to be a way to establish contact and I'm only willing to give very basic information on a public forum.

If you have an attorney willing to handle this that's good. Are they willing to work on a contingency fee agreement? I hope they don't want to charge you hourly.

Wachovia Dealer Services WDS and Balboa Insurance Service BIS fraudulently added two Collateral Protection Insurance (CPI) policies on 08/2002 & 09/2006 for the amount of $1,600.00 and $1,200.00 plus interest, late fees, collection fees, etc.

I provided WDS and BIS evidence of insurance but they overlook to fully refund my account. I have been juggled by them with deceptive acts over and over again. WDS either finds new-found lapse insurance (fallaciously alleged four) or declined to contact BIS to verify insurance coverage and refused to return funds for CPI.

Whatever it was, I was referred to BIS (self-governing) to resolve the matter. Balboa Insurance Service affirmed having inclusive indemnity documents in order on file and denied any lapse claim. WDS knowingly and intentionally has failed to fully return undue CPI costs and allow the outstanding to accrue penalty fees for over a year. To date, the total amount credited for CPI charges is $3327.21. The remaining $400 is in past due and accruing monthly penalties.

Consequences began 10/2006; WDS began reporting severe delinquency entries on my credit profile. WDS failed to validated the dept or retract the reports to the credit bureau agencies I requested. For more than one year I receive regular abusive calls from WDS despite the verbal stop calling requests and a written cease communication letter. Examples of harassing conduct made by a WDS collection supervisor were threats to take action against my property, credit, and repo the financed vehicle, repeat calls that caused the telephone to ring repeatedly and denied her identity.

I have well documented my complaint and have kept a summary of detailed records of contacts including documentation of the many requisitions and other correspondences I made. I file a complaint with Wachovia Dealer Services- Office of the President, Irving, TX, WDS -Claims Department Ontario CA, Balboa Insurance Group, Federal Trade Commissioner, Department of Insurance, Federal Reserve, and Better Business Bureau.

I am in the planning stages of taking legal action against WDS and would rather like to in a class action. Please keep me posted.
