Not to be nosie, but overheard about this situation via third parties and had to

Child support is stipulated by court order - a specific DOLLAR AMOUNT is what is ordered, not some vague XX percent of income.

The same order would have also noted who the custodial parent is, and very likely stipulated restrictions regarding where the child would live.

I doubt that ANY US COURT would have permitted you to remove the child, a US citizen by birth, from the US to live in Canada or any other country. Further, as the MOTHER of a minor US citizen, all sorts of assistance programs were available to you; education, welfare, legal representation for enforcement of child support, etc.

The court ordered 30% of Walt's income in 1988, but even that was based on

fraudulent income and expense reporting to the government from Walt that he

signed under oath.

When Walt realized that he was at risk for criminal prosecution for fraudulent

reporting, he convinced Leesa to sign ANOTHER document to 'deal with the order

and issues regarding their son between themselves,' and promptly took the two

months of the involvement of the DA out of the situation, including dissolving any

formal investigations of his TRUE INCOME.


BUT the order still stood, unaltered, unrevised and unhonored with s**t bits below

poverty level as Walt would cry his usual crocodile tears every month for twenty

years saying how penniless he was.

I've been through the divorce and child support legalities here in the U.S.

Child support is ordered by a court, and the court order specifically STATES THE AMOUNT to be paid, usually on a monthly basis.

So Leesa, what is the monthly dollar amount that the court ORDERED for child support? When was it ordered and how much in arears is he?

Visitation: I know from experience that the US courts FROWN upon moving the child away from either parent. My divorce decree (from 1978) specifically stated that my ex-wife could NOT move my child out of NY State (without a NY court agreeing to it), let alone moving to ANOTHER COUNTRY. When my ex-wife moved out of NY state I went back to court and the judge issued a bench warrant for her arrest (contempt of court). This bench warrant was in effect for almost 2 years.

So Leesa, did you VIOLATE the court order (agreement) when you moved the child from Florida to California?

Did you VIOLATE the court order when you moved the child to CANADA?

Could this be part of the reason that there might be an arearage in child support?

Could this be part of the reason that the father didn't see the child that often?

Could this be the reason you and your son don't go to Florida to sue for this alleged arearage in child support?

Also, the promise of a gift is NOT actionable. Example: If I promise to give you $1000 for your birthday (or pay for college) and when your birthday comes I don't give you $1000, that is NOT ACTIONABLE.

Unless there is a court order that the father will pay for college, you or your son have no claim to any "college fund."

As to enheritance: A well executed will can EXCLUDE ANYONE. Do not assume that you or your son have any right to any enheritance should the father die. I highly doubt that a VP of a corporation would be foolish enough not to have a will. Anyone can exclude anyone in his/her will.

As I stated before, there are 3 sides to this story. Yours, his, and the wavy line down the middle called "the truth."

The Judge at the Superior Court of Justice was a very smart man in ascertaining
