I purchased a used BMW from a dealer in Indiana and was sold a warranty at the time of purchase. I was told it was better than the warranty I had on my previous vehicle. Two weeks after the purchase of the vehicle the engine suffered a loss of oil due to a part Warrantech claims they do not cover and therefor they refused to cover the engine. They denied the dealer claims and denied my claim when I contacted them about it. This was in October of 2017.

I am sitting here 4 months later and still don’t have my car. When I contacted them to dispute this and threatened them with a lawsuit they told me I had to submit to binding arbitration. The person on the phone is obviously reading from a script and has no understanding of the contract or who they are speaking with. You cannot force someone in Indiana into binding arbitration. Their contract clearly states that. The next issue is there contract clearly states in Level One see list of covered parts. You look at level one covered parts and it clearly states the engine. The contract reads like a 12 year old with ADD wrote it. Like items are not in the same area, it skips and jumps around, it is all over the place and is intentionally deceptive.

What Warrantech needs to understand is that I have hired an attorney, he is taking "Legal Action" against them "Not Arbitration" and they will be found to be at fault in this case. I am intentionally remaining vague on this issue because there is legal action in process. The attorney read the contract the same way I did, the same way the dealer explained it and in a way that the laws of Indiana view warranties Technically, under their interpretation of their contract they could deny any claim they chose to. A perfect example is as follows: They clearly state that if rod bearings go bad they will cover the engine. What they don’t tell you is that the way they try to avoid payment is since oil starts to break down from the moment it is put in the engine, and oil is a non-covered part that they can blame the warn out part on a non-covered part and refuse the claim, regardless if you have proof of service.

What they don't understand is in the State of Indiana that is called intent to commit fraud. I hope and pray this actually turns class action. No Warrantech in the state of Indiana you cannot force me to Binding Arbitration your contract clearly states that and your phone people obviously can’t read that either. Your Warranty clearly states a list of parts covered and you try to back out of that with meaningless nonsence about non-covered parts. This time a contract was sold to someone who will fight back. If you see an auto dealer pull one of these warranties out save yourself the trouble and say thanks but no thanks. You will save yourself $2500 and legal headaches. You may eventually get your car fixed but at what level of time committment and labor cost to yourself.
