I sent my watch to watchbrokers.com in December 2010 and it sold January 15th.  They told me my check was in the mail.  It's now been 2 months and still no check.  They will not return emails and it is near impossible to get them to answer the phone.  Eric Toso, my representative, at watchbrokers.com told me they would reissue the check and send me a tracking number.  2 weeks later and still not check or tracking number.  He will not answer my calls now or return emails.  TOTAL RIP-OFF, SCAM.

Response to Attorney representing WeBuyWatches.com - WatchBrokers.com

AUTHOR: Donna A. - (United States of America)

POSTED: Thursday, September 01, 2011

    In response to the "Notice to Cease and Desist Internet Defamation"

    I've read over my original post concerning WeBuyWatches.com also known as WatchBrokers.com.  I believe my statements to be true and correct.  I did receive a check, but not until I filed a complaint with the BBB and made a report with this website.  The BBB has given WeBuyWatches.com and WatchBrokers.com an F rating along with an alert for this company.  Please see http://www.bbb.org/atlanta/business-reviews/watches-dealers/webuywatchescom-in-atlanta-ga-27291341

Dear Ms. Donna A:

Please be advised that my firm has been retained by Webuywatches to investigate and to take the necessary legal action for unwarranted and defamatory attacks against Webuywatches by you, user name, Donna A..

Webuywatches has been in business for years and has been very successful in buying and selling watches to its customers throughout the world and satisfying their customers needs. Webuywatches.com has established a well founded reputation for the quality of its services and customer satisfaction. All customers who sold watches to Webuywatches.com did get paid in full. Webuywatches never, nor intended to deceive, withhold or steal from its customers whatsoever.

You specifically referenced to Webuywatches in your post that Webuywatches is a rip off scam are made with false accusations and without merit.  In addition, they are misleading and defamation per se in that they depict my client as engaging in fraudulent activity that violates civil and criminal laws, thereby damaging my clients reputation and adversely affected its business.

My client has already compensated you in the amount of $252.00 via Bank of America bill pay check on March 14, 2011 pursuant to your signed Customer Service Agreement with Webuywatches.

Pursuant Texas Law, Civil Prac. & Rem. Code 73.001. A libel is a defamation expressed in written or other graphic form that tends to blacken the memory of the dead or that tends to injure a living person's reputation and thereby expose the person to public hatred, contempt or ridicule, or financial injury or to impeach any person's honesty, integrity, virtue, or reputation or to publish the natural defects of anyone and thereby expose the person to public hatred, ridicule, or financial injury.

Your attempts to spread libelous and defamatory material about my client have caused serious and irreparable injury to it, its reputation, and its business.  My client will not stand by this and allow this misconduct to continue.

I hereby demand that you;

1.     Immediately remove all defamatory and disparaging remarks made by you, and

2.     Immediately cease and desist in posting any defamatory statements about my client,

Please note that this firm does not attempt to restrict legitimate free speech, and this firm believes that the internet is an important medium for dissemination of accurate and truthful information and for fair comment on issues of the interest.  However, the activities on Rip Off Report have unlawfully encroached upon my clients rights.

The purpose of the rebuttal is to put you on notice that if in the event you refuse to comply with the demands set forth herein, I will have no choice to recommend my client pursue all causes of action, including filing a lawsuit to protect its interest, including seeking court costs and attorney fees incurred by my client as a result of your actions.
