When My ex wife bought a car in wisconsin my mother, who lives in california, reluctantly signed as a cosigner on the car. The dealer sent it through and apparently My mother, who had better credit, was changed to the primary buyer without notification and now my ex wife who live in north carolina isn't making the payment and Wells fargo is calling my mother because she was listed as the primary buyer of the car. Not only did they change the primary and cosigner around but now they are refusing to call my ex wife and ask her why she isn't making the payments or if they can come and pick up the car.
Wells fargo Collections people use the gestapo tactic of calling and harrassing and threatening people into scaring them into a paying or making payments when they can't afford them. My mother is 68 years old and she has received 3 threatening phone calls from wells fargo this week. She has tried to tell them that she has contacted the repo department with their company and they need to go pick up the car. They refuse to call my ex wife saying that my mothers phone number is the one listed. My mother has even given them my ex's number and asked them to call her, she has the car!

I am not sure why people can go thru the entire process of applying and co-signing for a auto loan and still don't get reason there is a need for a co-signer in the first place. The whole reason someone has a co-signer is because there credit is not strong enough to borrow against. so when you co-sign for someone your letting them use your credit to borrow against, thereby making you responsible for the pymts of your loan. If something were to go late to the point of affecting credit, it would be the person who's credit was strong enough to borrow against that is affected.

So Wells Fargo is doing you a favor when they contact you about a pymt that is late. Also, believe it or not Wells Fargo does not call customers to harass them or hassle them about pymt, we simply want to acquire all the information in case there is a way we can help you with a special situation. We contact customers to give them an opportunity to work out a pymt option before you would acquire late charges.

So by ignore the call or cussing out the representatives, your only hurting yourself. It's totally understandable that things happen and money issues are unavoidable, but don't be shocked or insulted when a billion dollar company contacts you about a 20,000 dollar loan that is late. If you contact Wells Fargo and are unhappy about your service, customer service is there to make things right. it is 180055WELLS, Thank you

I know for a fact that the dealer made your mom the primary because they are the ones who check your credit first then submit the information to the different lienders, so wells fargo did not change the co-signer or signer info...

On another note i do remember calling account holders over and over again and thats because other reps were not notating the accts correctly, meaning not seting out the call out the correct amount of days. because every state has their own laws on when you can call, or where you can call a person and how many times you could call them on any phone number submited.

i remember calling customers the day that they were due, when i was @ wells fargo auto finance. the rule was that we can start calling customers after 3 days of being late; i.e: if your due date was 01/31 then we could start calling on 02/04. but alot of people did not understand that.

When you purchase a vehicle the finance man would tell the byer that they were'nt considered late till ten days after the due date, thats incorrect. you are considered late if the payment is not in on the due date but you have 10 days from the due date not to get a late fee.

I always had to explain that to customers, and unfortunately wells fargo does have the right to call you about the acct if you owe them money, but they just have to abide by the diff. state laws on the limit to where and when they can call you. But no matter what they should be calling both partys on the loan and they both have to agree to have the car voluntaraly picked up, and just to let you know thats still goes on your credit has a repossesion. thats all i have for now.

if anyone would like more info on WF auto finance please respond and i'll try to answer as much as i can or remember. thanks

Let's suppose the phone number your mother has is out of service. Why would Wells Fargo keep calling a disconnected number, obvioulsy your ex-wife is not paying since she let the loan fall behind and being a co-signer or primary doesnt mean that one is not responsible or Wells Fargo wouldnt call if one of them defaulted on the loan. Even if your mother drove the car and she missed payments they would call your exwife as long as they had a valid number for her.

I think there is more to the story that he is not saying, like maybe his ex-wife keeps avoiding the collectors and the only person that picks up the phone when called is the mother. one is just as good as the other!! Especially when they have both on the hook for paying.

I have collections experience as well.

I dont understand why wells fargo will not call the ex. My dad is the primary on the loan that I have and they call me instead of him. My dad just told them that I handle that account because he is old and unable to keep track of it. So when ever they have a problem or when they loose a payment, which they do almost every month. They call me. Just have my mother send them a letter stating that the ex is taking care of this account and put the ex address and number in it.

First, it was the dealer who switched the names. Usually there are better terms offered when the person with better credit is listed first. This would seem to be a rather deceptive practice except that..

Second, the name order doesn't matter. All signers are equally obligated to pay. The company can choose who to pursue more agressively in collecting the debt. Logically they would go after the one who is likely to have more money. Even if your mom was listed second on the loan, the company could do exactly what they're doing now.

Third, having the car repo'd will make the situation much worse. It does not relieve the debt. They will sell the car for what they can get, typically very little, almost never enough to pay off the loan. Your mom and your ex will still owe the difference, and bill collectors will still be calling. Your mom's credit rating, already damaged by the missed payments, will be almost completely ruined after a repo.

Your mom should catch up the payments, and go take possession of HER car. She can use it for herself or sell it, if it will sell for enough to pay off the loan.
