I was, and still am to a lesser degree, one of those unfortunate, impoverished individuals who was never really taught about money management or credit when I was younger. I, like many others, had to learn these lessons (although apparently not all of them) through the School-Of-Hard-Knocks and my credit rating has taken a pretty severe beating in the process.

In the summer of 2000, I was forced, for the very first time, into purchasing a replacement vehicle for my 1990 Shadow for which I had paid cash in 1989. I didn't know a thing about vehicle loans or financing, so I decided to buy a used vehicle since it would be less expensive. I did so hoping that if I made mistakes purchasing another car it wouldn't hurt quite so bad.

I had just started in an electrical apprenticeship program so money was in very short supply. However, I lucked out and found a '96 Chevy S-10 Pickup with only 40,200 miles on it. The dealership got it financed for me for 6 1/2 years through a bank called First Security. The final payment on this note would be in January 2006. The loan payments and insurance just barely fit into my budget but I worked diligently to ensure the installments were consistently paid on time and have continued to do so for the last 6 years.

A couple of months after I financed the truck, Wells Fargo came along and absorbed First Security. I got a chuckle over this when I realized Wells Fargo had originally denied me financing for the truck but now had to deal with me anyway. I thought I was finally starting to gain the means to improve my bad credit. I guess I should have known better.

Everything ticked along smoothly until the first of the "Payment Holiday" offers arrived. I thought I must be doing something right to be getting offers to defer payments until the end of the note. I read and re-read the offer to ensure I understood how this deferral would impact the note and how the payments would be made.

The language of the offer stated, "...,your December 2001 loan payment will be deferred without impacting your credit rating. The deferred payment, plus a $35.00 deferral charge, will simply be added to the end of your loan. This will result in an extension of the term of your loan beyond the current scheduled maturity date by one additional month. Finance charges will continue to accure..." I don't know about you but that language tells me the deferred payment will be added to the end of the loan and the loan will pay off a month later than originally scheduled.

A little further down the page and presented almost as an afterthought, the offer states, "If the payment holiday results in an increase to the final payment of your loan, you will have the right to refinance this payment without penalty on terms that are no less favorable than the terms of the original loan." IF...such a big meaning for such a little word. It's a "might happen", a "maybe", not expected to happen but it could happen. Under these circumstances, the language states how the event would be handled. I understood it to say that the refinancing would go into effect with my signature which means they would have to send me paperwork to be signed.

I didn't see anything detrimental so I accepted the offer and skipped a payment for the first time in December 2001. Additional offers came about once every 6 months and I took advantage 6 consecutive offers before I turned the last one down for June 2005. I believed I had extended my note by 6 months and the new final payoff date would be in June 2006.

I generally make my payments on-line since I only need to transfer money between accounts to make the Chevy payment and it's much faster than waiting for a check to clear. The paper invoice comes in the mail as well but I rarely open it since I know the payment has already been made.

I made the January 2006 payment(the old final payment date) on-line as I normally did. I noticed nothing out of the ordinary in doing this so I paid the paper invoice no mind when it arrived.

Three days after the payment due date I start getting strange unidentified calls without any voice mail on my cell phone when I was at work. I don't answer anything until break time or lunch and everyone who knows me knows to leave a message on voice mail if they need to talk to me. This goes on for a week or so until finally around March 10th one of the collection minions leaves a message and a phone number on voice mail. I call the number after work only to discover that she only works until 2:00p.m. I try the next day and find out that my truck note is now considered to be in default because all the deferred payments have been added to the original final payment and I didn't know anything about it in advance (no documents sent to be signed) nor was there any indication on-line that the bank had decided to implement it's "IF" statement without giving any notice that it was going to do so.

At this point, I start demanding answers to the obvious questions that anyone familiar with the loan's history would ask, such as, "Why weren't the primary terms of the payment holiday offers implemented?" To which little miss obnoxious, shrew, Nicole Swadling tries to sidestep by telling me that Wells Fargo isn't responsible for any offers put forward by First Security. Nevermind the fact that every single one of the offers has a Wells Fargo logo in the upper right hand corner of the page and the text identifies the sender as Wells Fargo...1st stupid mistake. When I point this fact out to her she hums and haws around and ultimately cannot provide an answer. Neither can she provide answers to the other obvious questions of, "Why wasn't I notified in advance this was going to happen and where is the paperwork I am supposed to sign in this event?" The only thing she seems to know how to do is act obnoxious, demand payment, lie unconvincingly, display her stupidity and generally be an excellent example of a lousy excuse for a human being.

There's a whole lot more to this story but I'm too tired right now to tell it. I just thank God the paper trail is in place. Where's a good attorney when you need one?

I financed my new truck through Wells Fargo almost a year ago, and so far so good. I've not had any trouble at all. To everyone that has written about Wells Fargo or any other finance company, DON"T ever pay in cash. (You have no proof!), I pay everything online, print out my confirmation and attach it directly to that month's statement.

So I have paper record, online printed record with confirmation #'s and immediate bank records. Always immediately read your paper statements mailed to you when they arrive. You never know when an error might occur and those few days between when your paper statement arrives and the next due date could make all the difference in a dispute.

Looks like this may have been your FIRST mistake, and it s****.> 'The paper invoice comes in the mail as well but I rarely open it since I know the payment has already been made.'

I pay every one of my bills on line, but still open the payment notice. And it's exactly for reasons such as this. Many times the statements contain information regarding the account covered. Have you looked through the unopened 'paper invoice(s)?' Oh, you say you don't keep them? That's your SECOND mistake.

The delay in forwarding the appropriate paperwork to you is in no way your responsibility, but looking at your accounts is.

I left off with little miss obnoxious Nicole Swadling not being able to answer my questions on the 10th (I think I said it was March 10th but actually it was Feb 10th). She actually expected me to pay off the balance immediately and tried her best to get me to do so. It was only after I made it clear that wasn't going to happen and that I expected the terms of the offers to be honored that she asked me if I wanted to reschedule the remainder of the loan. Well DUH!!! She said she would put in the request and that paperwork would be on the way.

Meanwhile, Chris, Rachel, Mitch, John, Brian and a couple of others that I didn't catch names on kept calling me every day at work and at home. If they left their name and a phone number I returned the call. I would explain to each one that I had already requested a reschedule and that I was waiting on paperwork. Each one assured me they would make notes in the computer file. Next day would roll around and here we go again.

On Feb 16th, it was Rachel's turn and I managed to get out of her that the reschedule request had been approved on the 14th and it was Nicole's responsibility to get the paperwork out. I asked her when I could expect to see the paperwork and she told me that it probably went out in the mail the next day and that if I didn't see it within a week to call them back. I also confirmed that I would be making the Feb payment on time, on-line as usual. I then ignored any other calls that came untiil the 23rd when Mitch called. I still didn't have any paperwork so I called him back immediately to try to find out what was going on. He told me I needed to call Nicole and gave me her phone number and extention. I called her and asked her where the paperwork was and she confirmed that the reschedule had been approved on the 14th and paperwork had been sent out. If I didn't have it she would send it again. This was a bald-faced lie if ever I heard one. How is it that every other little scrap of paper sent to me by Wells Fargo always manages to reach me except the one that should have been sent out automatically weeks ago when they decided not to honor the primary terms of the payment holiday offers and balloon my final payment. Little miss obnoxious liar also neglected to mention that she had sent out a nasty-gram (matured loan notice) the day before I spoke to her(Feb 22nd) asking for the paperwork that should've already been in my hands, signed and sent back. I made my Feb 23rd payment and waited.

Eight working days later (Mar 7th) just as I am arriving home from work, I get a call from John who identifies himself as the collections charge off manager,demanding to collect the remainder of the balance or he will charge off the remainder as bad debt and report it to the credit reporting agencies. I tell him that the people in the collections department need to either learn how to use their computers properly or start talking to each other face to face since this issue was already being handled. He suggested that I just pay off the note out of my income tax return which means he had already been snooping around in my accounts. I told him there was no way just as a matter of principle at this point. John informs me that I am being very uncooperative and that my loan is delinquent and should be paid. I ask him how my loan could be delinquient when I followed instructions from the collection department, made my Feb payment as promised and was forced to wait on paperwork from his office before anything else could be done.

Just about that time my husband comes through the door with the mail in his hand Lo and behold, the severely delinquient reschedule agreement has finally arrived for my signature. It's dated Feb 28th(prepared 3 working days after I call) and postmarked Mar 1 from Salt Lake City(no big rush on her part). I inform John of its arrival and he states that I should sign it and fax it back to him as soon as possible. I tell him that is exactly what I intend to do but it won't be happening until the next day when I can get to a fax machine. Next day, Mar 8, I do exactly that and get a transmission confirmation from the fax machine. I think this is finally under control but I'm still in for a couple more brutal surprises. On Mar 13th, I receive another nasty-gram (matured loan notice) dated March 9th and postmarked March 9th (the day after I signed and faxed the reschedule agreement) from none other than the little miss obnoxious,irresponsible,lying shrew Nicole Swadling (preparer of severely delinquient rescheduling agreements). The latest zinger is that these people have reported my loan to the credit agencies as being 30 days late. Now, whose fault is that?

Like I said yesterday, where is the attorney who likes a good fight. I have all the documentation (all the offers, time-line backed up with phone records, the notices with envelopes, signed agreement with envelope it arrived in & fax transmission confirmation)to back up everything I've said.
