I cash my payroll check at Wells Fargo Bank. By law, they are supposed to cash my check. Rather than cash my check, I'm usually given 15 minutes of a branch manager telling me they cannot cash a payroll check unless I open an account. Then he told me I had to open an account. I told the manager that he was in violation of the Business and Professions Code. He then got nasty and charged me $5.00 to cash their own check !

You have bounced back and forth more times than a ping pong ball. You were first upset that you thought they were violating laws and regulations. That has been shown you were incorrect in your thoughts. You then say we missed the point because you don't want an account and don't want a commercial. But specifically said you don't mind paying the fee. Then in your next post you said it is about the fee. So exactly which of your many points are we missing?
There is probably a lot more going on here than you are saying. You probably have something else against Wells Fargo that has nothing to do with them cashing checks. Which if you do...fine. But when you seem to change things on the fly or embelish certain aspects($450 an hour..really?) it does not help what ever point you were trying to make.

You missed the point - its the fee for cashing a check that upsets me. You're questioning whether I have a bank account. And yes, I have an account, but don't like rushing to my bank when WFB is in my building.

The point of this rip off report was not about the $5.00 fee. I don't mind paying that. The point is - I can't cash a check without the 15 minutes of Wells Fargo's crap about opening an account. I sent them an invoice for keeping me there for 45 minutes wasting my time, at $450 per hour. I was that upset.
And Karl - get a life !

Bank of America does the same thing - Everytime my Father gives me a check drawn off his business account they charge me $5.00 BUT everytime my Mother gives me a check drawn off her personal account NO fee

Why not do this, open an account with them and keep $5.00 in the account. By doing that you are then considered an account holder and can us the drive thru and cash the checks without any other fees. That is unless you are a dead beat who owes money at other banks around town.

It is free, and your funds may be available much quicker depending on the bank/credit union.
My paycheck is available for spending/withdrawal right after 12:01AM of payday. It used to be 10PM the day before but they apparently changed. Someone I work with belongs to a credit union and his direct deposit is available almost 24 hours earlier then mine.
The only down side is you can not stop the direct deposit at will, it takes 2 weeks in advance to make any changes. But I prefer it over checks and dealing with the bank and standing in lines and fighting with managers who want to manipulate you into opening an account with them and charge for cashing their own checks if you don't, screw that. I'd rather flush that 5 bucks down the toilet then give it to Wells Fargo, or at least buy lunch with it.

Wells Fargo is not required to cash your check for free if you are not an account holder. In fact, a number of banks charge this fee. There is no law against that.
However, Section 212 of the California Labor Code requires a California employer to arrange for a place where employees can cash their checks without a fee. I'd have a talk with your boss if I were you.

is charged by all banks that I know of when an individual without an account at the bank cashes a business check. The banks are in business to service their customers. If you do not have an account with them then you are not a customer. Some suggestions to avoid this fee are: open an account with them; cash the check through your account at your bank or see if your employer has direct deposit.

There is no federal law or regulation that requires national banks to cash checks for noncustomers. Most banks have policies that allow check cashing services only for customers who have an account with them in order to protect both themselves and their customers from forgeries.
Once a national bank cashes a check that has been forged by a noncustomer, they may lose money if they cannot collect from the person who cashed the check.
Also, if a national bank agrees to cash a check for a noncustomer, it may legally charge the presenter a fee.

I believe you are mistaken.
Decades ago, circa 1975, an FDIC insured bank HAD to cash a check drawn against the bank without charging a fee to do so. That particular FDIC rule was changed some time ago.
Kindly post the exact cite of law that you believe prevents a bank for charging a "check cashing fee" to non-account holders. I've searched for one since 1994 and have yet to find a CURRENT prohibition to this practice.
