I WAS HIRED BY THIS COMPANY TO BE A CROOKED "BILL COLLECTOR)
I NEVER HAD TO BE A CROOK LIE MOST OF THEM, I HAD TO CREATIVE AND TRIED HARD NOT TO LIE OR MISLEAD PEOPLE, EVEN THOUGH I WAS TOLD TO BE DOSHONEST:
WHEN A FINALLY DECIDED THAT I COULD NOT DEAL WITH THE INNER OFFICE CORRUPTION  ANYMORE
I SPOKE OUT AGAINST MY COMPANY, AND LEADERS OF THE MANAGEMENT TEAM
AND AS A RESULT I WAS QUIETLY LAID-OFF!
I NOW INTEND TO SUE, WEST ASSET MANAGEMENT LOCATED IN ENDICOTT, NY
FOR AGE & GENDER DISCRIMATION. I ALSO INCLUDED DISCRIPTIVE FACTS THAT WILL BE PUBLISHED THIS YEAR.
I JUST FILED A COMPLAINT WITH EEOC/HUMAN RIGHTS DIVISION  
I THINK IT IS IMPORTANT TO SHARE THIS STORY WITH THE PUBLIC SO PEOPLE
REALIZE THAT THAT CAN FIGHT BACK, AND GET RESULTS IF YOUR EMPLOYER IS ION THE "WRONG"

  To Whom It May Concern,
  My name is Gerald W and I believe I have been discriminated against on the bases of age, gender, and on the bases of Whistle Blowing certain members of management. I believe it was the above allegations that led to my improper Lay-off. Even if the reduction of workforce was unavoidable, I was still qualified and able to work any position in the office on any client, and had previously made these adjustments throughout my employment as clients have been pulled out of the office.   
  Besides the original employees who remained in 2009, I was the only male. Any employee who worked for West Asset Management (other than the five mentioned) located in Endicott NY came after me including several managers who all partied with Lisa J. Nichols mostly in local bars.
I strongly believe because I no longer chose to party with the girls, I was mistreated by The Operations Manager, Ms. Lisa J. Nichols. I have worked with the Operations Manager/General Manager for over 10 years and in the past I did party with her infrequently at bars. I even went to a concert with the manager and her friends but now I believe she has crossed the line. As soon as I stopped associating myself with the manager and her friends since 2004, she made it difficult for me at work for years and made it impossible for me to get promoted or receive adequate commissions as I have done so successfully in the past.
    She often played with the idea that I will be promoted soon, and then later she would say I would have to wait. This fiasco went on for years with no change in title. I was even invited for lunch by The Vice President of Operations (Thomas Callahan) along with Ms. Nichols in 2007 and was guaranteed a promotion, and even shook hands afterwards feeling exited only to be let down again after months became years.
  In April of 2008 I filed a complaint about a breach of a written agreement concerning my salary, and continued false promises made by both Lisa Nichols and Thomas Callahan. After a series of correspondence, I received some compensation but as a result her mal treatment and ill behavior against me only increased.
   
Of all the employees that were laid-off I was employed for the longest period of time and I am the only employee that received a written agreement and an implied verbal contract that I would not be terminated over less tenure employees or would have to work under Dawn Proctor.
After my initial series of complaints according to Allyson Jeter (Div VP of Employee relations) I was supposed to move to another client as usual until she emailed me that,
the 3 rd Party business no longer had no openings (untrue), and that the 1 st party business has a threshold, (meaning that I made too much to work there) and that no supervisors were needed even though supervisors with less experience, and education were previously hired before me and are still presently employed.
Of all the laid off employees I am the only employee that is over forty years old and was likely the most frequently moved employee in the office. In essence I had vast experience on any client and was able to work any position including as an Operations Manager.   In civil court I will provide several witnesses that will corroborate this.     I am a former original employee of West Asset Management located in Endicott NY.13960, recruited by Tom Callahan & Matt Carroll in April 1, 2002 . The original name in the Endicott NY branch was National Asset Management.
The former President was Darrel T. Hanna and CEO Frank J. Hanna Jr. I contributed to their success as a diligent collector to drive the appeal for National Asset Managements positive revenue and helped along with other core employees to make it a profitable business to sell for $166,000,000. Even if my contribution was less than 1 half of one percent I will gladly accept any dividends from that effort.
 
A written document was signed by Matt Carol a former Vice President, and I therefore agreed to work as a Collector for a monthly salary of $2700 per month months later I was promoted by Matt Carol as a production manager as a result of votes from my peers when I switched to a new client near the end of that year I returned as a collector for no real cause other than business needs. When I complained about the change to Matt Carol, I was told to wait a few months and I will regain my title shortly, before the acquisition took place and NAM became West Asset Management    my salary was reduced and Vice President Mathew Carroll was involuntarily relieved from his position and Lisa J. Nichols took his place and remained an Operations Manager.
 
Since then I have voiced a number of concerns, and some of these were in writing. I noticed people selling smoking marijuana in the parking lots before heading to work. people coming to work intoxicated and still being allowed to work. I noticed Managers
hiring based on their personal sex desires, and many whom established relationships with their subordinates.
 
In 2004 an employee by the name of Darius Davis was harassed by a manager   thought to be a racist by some employees (Dawn Proctor, Lisas friend)   to the point that he that he verbally exploded, and was fired as a result. He later filed a complaint with the EEOC but at that time, I was not in position to help him. Many people including myself knew that he was being mistreated despite his exceptional performance but would not speak out because the need for job security and/ or fear of management retaliation.
 
Employment relations or (ER) personal does not keep complaints confidential. As a result the details of any complaint are usually discussed with Lisa J. Nichols, even if the complaint is about her. Anyone who has attempted to make a complaint about Lisa J. Nichols or any of her friends were either fired, or harassed until they were forced to quit.
 
I noticed employees signing off on contest that they were never in. I often wondered if monies collected from in- house fundraising events were pocketed and shared between selected groups. I also noticed that people who illegally transported cigarettes from across state lines were regularly able to sell those cigarettes in our office for a discount.
 
In fact I even witnessed Lisa J. Nichols (Operations Manager) allowing even a non-employee access to our secured building to sell these illegal cigarettes. I cant tell you how many times Lisa Nichols came to work still impaired from alcohol abuse from the previous night.
 
Lisa J. Nichols teaches people to lie, cheat, steal and do whatever it takes when it comes to collections, as she was taught this by her former leader Matthew Carol. Lisas classic response to my complaints are; Who are they going to believe? You or ME?
  Sometime between January and April of 2008 I was told by another employee at the time that Lisa J. Nichols told her to have sex with the Vice President of operations (Tom Callahan) at that time. Later that same individual became a supervisor with only a high school education, and previously about to be fired from another job. (if the name is required I can provide that later) Lisa Nichols acts are despicable, and require an investigation.
 
A simple spontaneous drug test, for all employees employed at West Asset Management   that havent had   a drug screen   in Endicott NY would prove at least some of my allegations. If you talk to the bartenders at most of bars in Endicott NY they will likely know Lisa J. Nichols by name.
 
It will be necessary to obtain my employment records and pay records from April 1 2002 through July 2, 2009 to corroborate some of my statements. You can also review my client logs, to obtain information on exactly how many different clients I have worked since 2002.
 
I also have corroborating recordings, emails, as well as a suggested witness list of both former and current employees to support my information. I have awards and positive reviews that prove my above average performance since 1999 as a collector.
 
If employees knew that they would be able to speak in confidence without retaliation then I believe that the proper authority would close down West asset Management in Endicott NY.I have seen people being fired by management after the same manger stated to Lisa Nichols that they need figure out how to fire that person; and in the end They were fired without a good cause in many cases.
 
Despite all of what I have seen, I have tried to remain silent and continue to do my job.
Despite the excessive favoritism, fraternization, misconduct and corruption that surrounded my office.
 
I have directed a number of the above complaints to management to no avail and even threatened to report them but because of fear of retaliation I did not. I then dealt my own personal abuses instead which I could not keep silent.
 
In April of 2008 I adequately demonstrated a material contract breach and as a result my salary was increased and I was compensated nearly $13,000 but this was no were near what was owed to me. Lisa J. Nichols made a number of complaints to her Manager Friends insinuating to management that; soon I will make more then her.
 
Lisa J. Nichols has discussed my compensation with nearly every manger in the office in front of me and without my consent attempting to harass, and or embarrass me to no avail. These failed attempts continued throughout my employment. Besides Lisa J. Nichols, Scott Underwood (another manager) also complained about my salary stating that last year I made more then him. Even thought this was probably true, I never once mentioned my compensation to anyone.
 
The actions of Lisa J. Nichols did cause the vast majority of management to become bias against me. I was repeatedly denied promotions after repeatedly being told by Lisa Nichols I will be promoted soon. I was written up even for breathing so to speak.
Because managers can indirectly affect your ability to earn commission, I knew that I would likely never again earn a bonus check thanks to Lisa J. Nichols.
 
In less then one Year I have been relocated to several clients, making it nearly impossible to collect additional; commission. After I felt that this last client was unproductive and the manager (Lisas Friend, Ellen LaPatra) was also bias I repeatedly asked to transfer to a different client and was denied despite that other employees of lesser tenure especially partying friends of Ms. Nichols were conveniently moved to the client of their choice.
 
After I began to report some complaints to Employee Relations, I was conveniently laid off even though there were other positions available that I would have worked. Therefore, I believe that I was intentionally placed in such a manner that even I despite all my verbal agreements would still be quietly removed from employment along with one manager(hired after me) and several newer employees (hired after me) as a cover up.
 
I believe that Lisa Nichols has falsely presented that there were no available positions to ER. Upon my information and belief; I believe that not only were there employees that were moved before, during and after my layoff but I suspect that other employees have been hired since my layoff. Because I was told that I might be able to work in October by Lisa J. Nichols, I decided to wait from July through October once again to call her bluff .
Lisa J. Nichols has only proved to be a poor acquaintance, a bad manager, and a compulsive- pathological liar .
 
If any of my above allegations are true, then I believe that it should establish that I was set up and my layoff was actually illegally and unconstitutionally UTILIZED AS A METHOD OF DIMISISSAL.
 
However, I will not go down gently into that good night and I will be seeking damages
and payment for the above, in or out of a civil court.
This time it was Lisa Nichols herself, who actually succeeded in getting rid of me.
If Ms. Nichols had at least some common decency towards me and others who were laid off and practically pushed out the doors, I could have otherwise considered the option to remain silent and victimized. However, I choose to exercise my civil rights as outlined in the Constitution of The United States.
 
Therefore, I request an inquiry on all the above, and ask that EEOC & The   NYS Division Of Human Rights support   my constitutional right to sue the above named employer along with Lisa J. Nichols for age & gender discrimination, and any other form of discrimination that is defined as a matter of law. Attached you will find many attached   documents   from 2007-2009 as correspondence from myself   or from Allyson Jeter as supporting evidence of my ongoing struggle to remain employed at West Asset Management.
