In March of 2003, we rented an apt. in Houston, TX so that my husband could undergo radiation and chemo for a malignant brainstem tumor that paralyzed him almost completely. We paid this apt. co. ( I forgot the name) for New rental furniture from Cort. Instead they put used and damaged furniture from their Corporate suite in our apt. and put the new furniture in there for themselves to use at our expense.

Everyday we had to drive to M.D. Anderson Cancer Center and as I had to lift my husband into his wheelchair, then take him to the car, lift him into the car and put the heavy wheelchair into our trunk , we were both exhausted when we got home. I begged the ladies in the office to correct this and they did not. I did not have time to deal too much with this as I was working with my husband's doctors to SAVE HIS LIFE! I notified the Apt. office of our checkout date 60 days in advance and they still KEPT our security deposit of $900.00 (?) & refused to return it.

Then the apt. co. called me and I told them our story, they AGREED to return our deposit and NOT to turn us over to a collector.

But they DID.

ANd then West Assets called and called us after we returned home to Kansas even while my Husband, was dying.

In fact, a very rude collector called the day before he died and offered to settle for less $.

I told her to SUE US & DID NOT PAY 1 red cent to them.

Now West reported to the Credit Bureaus that I settled the debt for less. I didn't!

Experian and 2 other bureaus are reporting that and when I filed disputes with them , they contacted WEST ASSETS and (allegedly) and said West verified it! So I wrote a letter disputing West's false info and asked that they send it to every bank that had requested info as I am trying to refinance my mortgage.

Like many Americans, I lost almost half of my money and the value of my home in the Crash in Sept.08 and this lying hole of snakes at West is preventing me from getting the best interest rates to lower my payments.

I have asked Experian to contact everyone who has pulled a credit report on me since 2003 and advise them of my dispute. So , far, they claim that since West "verified" the settlement - it is accurate!

Why is only the business's word accepted and not the consumers'?

If I can find the original paperwork from the Apt. I will sue both the landlord and West, but as you can understand, I was a basketcase after my husband of passed and in moving back home to Florida, much was lost.

Please if anyone can help me, please do so. Thank you.

I don't know if your confused, but the Sherman office of West doesn't handle the type of debt you are describing. It does sound like an unfortunate situation, however West only handles medical debt from the Sherman office. You might want to research the debt further as well as what West is reporting because it seems you are confusing this debt with another. Also, if it says settled, it certainly must have been pd or it would reflect unpaid on your credit report.

SAD TO SAY THERE ARE SCUMBAGS that will take advantage of a person's grief!

The time you should have acted was when you realized that the substitution had been made and then you should have called Cort rentals and told them that you had not received the furniture that you had paid for. You should have asked them where they delivered it and given them your address. I would have done it in person so I could show them my identification and I would have then insisted on copies of all of the invoices which I would have put in my HUGE handbag and not let it out of my sight. (You DO know that some managers will come into your apartment and STEAL from you if someone isn't there.)

YOU SHOULD HAVE SAVED A COPY OF THAT FURNITURE RENTAL CONTRACT.
YOU HAVE TO KEEP YOUR HEAD!

You can't EVER let down your guard for a moment! Because there are some lousy, crooked people in the world.

I would have also contacted the property management company where this ***** worked and told them what kind of scum they had working for them and how I was going to sue if they didn't give me back the furniture I had rented. And I wouldhave gone to kinkos and faxed them copies of the invoices I got at Cort's.

OK, they should have got the furniture back to you and if not, I would have contacted the police because they have stolen goods from you that YOU rented but they had wrongfully misappropriated. THIS IS THEFT and it can be serious depending on the amount of money that was involved.

And you should have called the TV station in Houston that does investigative articles on people and reported this to them. Who knows? With outraged people hearing this broadcast, maybe they would have donated money towards your meals and furniture expenses!

TOO BAD YOU DON'T HAVE THE NAME OF THE LOUSY APARTMENT COMPLEX BECAUSE I WOULD LIKE TO PUT THEM ALL OVER THE INTERNET!

If it has been more than two years, I don't see you suing to get your money back.
Without documentation, I don't now how you would prove your claim in court.

WHICH BRINGS TO MIND -WHERE IN THE HELL WAS YOUR FAMILY THAT SOMEONE COULDN'T HAVE CARED ENOUGH ABOUT YOU TO HAVE GONE WITH YOU AND HELPED YOU OUT WITH THIS?????????

I AM SORRY FOR YOUR LOSS AND SORRY THAT THE SCUMBAGS STOLE FROM YOU!
