I worked for west for a number of months, roughly from august of 07 to feb of 08.  they started us out at 9$ an hour with the promis of 11.50$ and benifits after we've worked there for 3 months. there were roughly 9 systems we had to use in order to conduct the required buisiness to provide Customer service to ATT's customers. each system had their own pass word, which we were required to change on a regular base's of every 2 weeks. in addition, we were required to use a single, unreliable, time consuming to set up, system to log all 9 of these other systems in, as well as clock in.

personally, i refused to use that system, because time and time agan, it would log out randomly and cause me to take more time to pull it back up without it clocking me out, and then log into the system i needed. therefore i would pull up individual systems as i needed them, and clock in and out manually, and was rather proficient with it.

however, i had an issue one week with the time clock clocking me out right after clocking me in. i took an early break one day, and discovered this, talked to my team lead, and asked them to check my logins and call times, because i had definatly been in on time. reluctantly he fixed it, yet still wrote me up, and then insisted that i use the main system that is supposed to handle everything at once, and that i would be written up (a pen 4 at this point due to being 1 minute late loging in from a 10 minute break, as well as not wearing socks with a pair of dress shoes, in addition to the previous stated Pen) i had less than a week left before all pens against me would have been cleared. in short, i use their unreliable login system

one day i log in and go ahead and work about 6 hours and then attempted to clock out for my lunch break. now, at the begining of the shift, i used their log in system, which is supposed to clock you in the moment you log into it. then it brings up a screen and logs you into your other systems, and then you can get started on the phones. when i went to clock out, it informed me i was not clocked in, confused, i pulled my time card. the system had clocked me out less than a minute after i had clocked in. and the management refused to correct the problem, even though it was clear by the log times for loging the telephone and every other system.

they declared it was a pen 4, and terminated me, and i didnt even receive pay for the  6 hours missed on the clock.

it isnt worth my time to deal with people or companies like that, i dont want anything from them. all i'd like to say is that working for them appears to be short term with everyone. everyone in my training class found themselves unemployed less than 2 weeks after i was let go as well, if they wernt let go before i was.

 i wasnt fired for clocking in wrong (i wasnt even written up or disciplined for accessing the systems manually to make sure this stuff didnt happen), i was fired because when i clocked in exactly how they wanted me to, it did NOT maintian my timecard and they refused to fix it even though by checking all other systems you can clearly tell i was logged into the phones, accepting calls, and working. you cant tell me that they dont have a log of how often each of their 9 systems are accessed.

so, like i said, i was not fired for not following their policies and procedures, its more like, i got fired when i did follow them.

as for being written up for not wearing socks, its absolutly no where in their dresscode and handbooks that says i'm required to wear socks with a pair of pennyloafers. or any socks what so ever for that matter. the only thing they ask is that you wear socks with sandals if you are a guy and you must wear sandals.

You say that you were trained and aware of the policy/procedure for clocking in and that you chose to not follow that policy. Since you did not follow company policy/procedure, how can you possibly claim this was a wrongful termination? If you work for a company you do things their way or hit the highway, easy as that.
