I went to a dealership and got a suv financed through western funding. My first car payment was due on may 8th i paid on the 4th. When i made a payment i went ahead and set up auto pay. They told me it was set up and to enjoy the rest of my day. June gets here and of course i dont call to make a payment because AUTO PAY WAS SET UP. June 22nd i get a call from a representative explaining that they havent received a payment. I immediately get upset because its only the 2nd payment and i was told auto pay was set up.. I asked them to go to the recorded lines but no one did so. I explained that i got paid the next day and i would call and pay it first thing in the a.m which they said was ok. So i call them the next day to make my payment and a representative explains that i nolonger have an account with them and to call the dealer. Im confused because i still have the car and when i call the dealer they tell me they dont know what im talking about and to call the finance company. I just want to make my payment because this situation was completely their fault. What should i do?

If the 2nd payment went through

Then you should never offer to pay again once you knew about it. You should never give any financial company your credit/debit card info via phone either. That's a very bad practice and could get you in trouble later on because the information can easily be misused. Anyway you will need to do some digging.

  • Was the withdrawal at the right amount?
  • If so, who did the withdrawal (get the detail from your bank)?

The problem may be from the finance company screwing up in different ways: the account wasn't set up correctly, the account wasn't tied to your car contract but someone else, etc. However, a part of the issue could be your fault that you didn't verify whether you have successfully created an account with them. Normally, you will get a confirmation of this kind of set up (auto-pay) via letter or email, so that you can use it to communicate with the creditor later on. If you didn't ask or receive any information of the account, it is a huge problem. It is possible that your information (bank account) is now tied to a different account. Often times, setting up an account via phone would go wrong because there is no "paper trial" to prove that the person on the line is doing it right.

Anyway, what you can do now is to talk to them again when you have all information about the withdrawl from your bank. Discuss with them about what they can track down the payment which was withdrawn from your account. Try to get them to understand the issue. Be patient.

 I admit when i wrote the complaint i was still upset so i left out a couple of details and wasnt able to go back and explain further more. But when i was called on the 22nd, after going back and forth about auto pay i went ahead and told him to charge my card but the representative explained that my payment was not going through and that i was about to go into repo so i explained that i got paid the next day and that i would be able to take care of the balance then and they agreed. I then went online to check my statement and seen that the payment was taken out on the 8th of june. This explains why my card declined because the funds were already taken out and were nolonger in my account. But im confused because i was told auto pay was never set up. I called that next day when i said i would make the payment to see if they seen the payment and if not i was willing to just pay again to not go into repo and deal with double paying another time but when i called i was then told i nolonger have an account with them. Hope i explained it better this time.

 My bank statement tells me they took the money out after all.. Thats why i said they took 2 payments.. Any more questions?

The funds were not deducted from your payment account in early June so why didn’t you have the available funds on June 22nd? There should have been no reason to wait until you got paid. Why do you claim they took two payments even though you later wrote that you were told you no longer had an account with them when you attempted to make the second payment?
