On February 3rd, 2006, I came across a website, the ProductTestPanel a division of Consumer Research Corporation that offers you free products for trying out products on their site. I found that they had a product (WhiteOverNite) I was interested in trying. The offer was, to receive a FREE TRIAL and all that I had to do was pay the shipping and handling of $3.95, which I did authorize. On the very same day, after research and finding negative comments about the ProductTestPanel/ Consumer Research Corporation (basically finding out that, they themselves are a SCAM), I immediately sent WhiteOverNite an email (copy of this email is attached) that said I changed my mindI didn't wish to try this product and not to charge my credit card for any shipping and handling, and do not send any further shipments. I later found out that I was committed to the FREE TRIAL for $3.95Fine, that wasn't a big loss for me, so I accepted the fact that I was not going to get my money back for that FREE TRIAL.

Then, on or around February 13th or 14th, I went to my bank account online to check on my account and found the charge of $3.95 (Skyfission LLC) had been charged to my account on February 6th, but then discovered another charge of $106.90 (also Skyfission LLC), which I had not authorized or was aware of, and this charge resulted in overdrawing my account. I immediately contacted TCF Bank about the charge and they were able to give me a phone number to contact. I then called the phone number (several times) that I was given and left numerous messages on their answering machine. Other times when I tried to call, their machine said to wait for a so-called customer service representative; I would wait and wait and wait, then an automated machine would say, Please leave a detailed message and telephone number, and someone will get back to you. I have not, to this day, received a phone call back or have been able to talk to a human.

Very frustrated at this point, I contacted NovaPointe LLC, this name appeared on the Checkout page and found that this is the company that WhiteOverNite uses for their online Point of Sale (POS) and reporting system. I was actually able to talk to a human, but was told that according to their Terms and Conditions I was not going to get my money back for that $106.90. These Terms and Conditions are on my Checkout page and it clearly states that fourteen days after you place your order, you will automatically be shipped a 60-day supply of WhiteOverNite and billed $99.95 +S/H to your card, and that this provides 7 days for the sample to arrive, and 7 days to try it.
NOTE: I obviously wasn't given those fourteen days to supposedly try the product, before they charged me.
Also Note that I cancelled (and received an automated reply/acknowledgement of my cancellation from them) on February 3, 2006.

Further, in their Terms and Conditions, for canceling, it states If after trying WhiteOverNite, you decide you do not wish to receive your next 60-day supply, simply contact us 30 days before the next supply is due to be shipped. Remember that I cancelled the very same day that I ordered my FREE TRIAL (February 3, 2006), which I did not receive until after February 14th. In effect, I did not even get to try the product within those fourteen days of receiving their shipment. I then received their next shipment, around February 17th or 18th (which was not authorized and I had thought that I cancelled on February 3, 2006) that they charged me $106.90 for. I have not yet opened it (hoping to be able to send it back and get my money back) but was told by NovaPointe LLC that even if I sent the package back, I would not get a refund. The packing slip, on the outside of this package, revealed a date of 2/11/06still not yet the fourteen days that they claim in their Terms and Conditions.

Now, even more frustrated, I have contacted TCF Bank to file a claim, and they have told me that TCF Bank is not legally responsible for reimbursement and that I need to contact these SCAMMERS on my own...which I had previously done.
