Wholesale Merchant Services, Lease Finance Group Fraudulent Sales Prcatices, Continued Harrassment Beaverton Oregon

When I signed up for their services, I was offered a three month trial period by their salesman, Lee ---. I was told that I could cancel at anytime before the end of the three month period with no additional obligation if I wasn't satisfied. To sweeten the deal, Lee offered to send me a check for $150 to cover the entire cost for three months.

On October 4, after having the service for only 2 weeks, $90.27 was taken from my business account for the first month's services and I had yet to receive the $150 promised in writing. Realizing that your company seemed less than enthused with telling the truth, I called on October 6 to cancel my three month trial period.

My phone call was met with harsh resistance and a rude attitude by their customer service representative who told me I was not allowed to cancel, even though the company had not fulfilled its obligation. I finally received the check for $150 on October 11, but when I went to deposit it to cover the first month's charges of $90.27; I found that a stop payment had been put on the check. I have since cancelled that bank account to prevent any more fraudulent withdrawals by their company.

I have continued to be harrassed by their partner company, Lease Finance Group, that does not recognize the 3 month trial offer given to me by WMS. They say that I owe $2626.50 for a non-cancelable 4 year contract. They continue to try to get me to pay for equipment that I do not use or want. I sent a certified letter that they recieved on December 13, 2005 stating that I disagreed with the contranct and that under the Fair Debt Collection Practices Act they were not allowed to contact me again.

They have continued to call both in person and by automated means about 5 times per week. They have also reported me delinquent the credit agencies. It is my contention that when they sent me a worthless check for for something they had agreed to in writing, it constituted a breach of contract and I am no longer obligated to the terms of the contract. LFG claims to have no affiliation with WMS but I only dealt with one salesman, therefore he was acting as an agent to both parties.
