Wilbur Westpfahl - Flatwork ripoff This Company did not live up to it's contract He got very angry when we brought it to his attention Very unprofessional with poor workmanship! Grandview Missouri

We contracted with Westpfahl Flatwork to tear out, replace, grade and add an additional 2ft to our driveway. He didn't grade or add the additional footage. He was very unprofessional. I called him to talk about the driveway. He hung up on me. He came back and added additional concrete that ran into the stairs leading up to the house. He left a steep incline in the yard and refused to fix the mess. The dirt and rock he dug up for this 'slab' that he added was left in the front of my house in a big mound. We had to grade the yard and put grass seed on the hill and the front of the house. He became nasty when I called and asked him to remove the mess. He also left concrete splatters on both garage doors. The concrete company had to come out and seal the driveway because he said he already did when we had a crack go from one side to the other. He was VERY nasty.

We filed a complaint with the BBB. The dispute ended up in Arbitration. He refused to show up twice! The president of the BBB had to send his Attorney a letter telling them it was ok for him to quit but he still had to fulfill the terms of the MIP he signed as a business and complete the dispute process with the customer. We had a on-site inspection with the My husband, myself, the concrete rep, Westpfahl and his two men, the arbitrator, and BBB rep. He came to that and lied, lied, lied! He stated he checked the paperwork at City Hall to verify the before width of the driveway. We produced paperwork from City Hall disputing his claim. He stated 3 different times he cheated us 3", 6", or none at all. We later found out he hasn't had a license to do business in Grandview in the last 2-3 years! We produced before and after pictures to prove the drive is the same. We had a lot of pictures from different angles to prove he was lying.

The BBB Arbitrator ruled in our favor. He stated the company did not abide by the contract, performed poor workmanship, and should have graded the driveway and added the additional footage. The company was ordered to refund a portion of our money on May 6, 2006. He refused! To date, he hasn't paid. We have since sent a letter to the Attorney General. Our next step is to take the Arbitration ruling to an Attorney or Small Claims Court. This company was VERY unprofessional and rude.
