Was served paper a few months ago with no court date on it. So I filed it in the no date bin. The original creditor Capital One has been on my credit report since 11/99. I disputed it then I dispute it now. Anyhow on 11/19/07 Williams Investigations garnish my checking account for xxx.xx Here the sweet part. The Bank is the one who notified me with a copy of notice of levy along with the slip misc.debit. The Notice Of Levy also states on it Amount of Judgement Owed ,Service Fees, and to make check payable to Williams Investigations. So I'm confused as to whether they are process servers or have they joined the ranks of the famous W@A as bottom-feeders. not real good with math but I think the SOL is closing fast or gone, and the scum sucker W@A has found a new sucker.

I am the co-owner of Williams Investigations. We are a statewide Service of Process and Private Investigation firm in Montana. I have recently had some questions asked about this report, and I would like to set the record straight.
The accuser was served with a Summons and Complaint by our company. The Summons instructed him to call the Plaintiff's law firm within 20 days of receipt of the documents or a default judgment would be issued and he would forfeit his right to dispute. The Complaint explained why the lawsuit was brought about. Filing such documents in the "no date" bin was unwise at best. Out company was then (after the 20 days) hired to garnish funds from the debtor's bank account. Upon receipt of the funds from the bank, we are required by law to send a Notice of Execution Levy to the debtors address. We keep certificates of mailing on file for every Notice of Exectution Levy we send. Montana State Law says that collection by Levy requires a Levying Officer to act as agent to the creditor. Therefore, we do charge (and inform of such charge) a fee for service of the documents. We are also required to receive such funds and forward them on to the creditor after we have held them for 10 business days to allow the debtor to claim any of the funds exempt from seizure.
