Windham is one of the collection agencies contracted by the U.S. Dept of Education to collect on student loans. This company began garnishment of my wages with no notification as required by law. I contacted them, advised I did not owe any money on a student loan and asked why I was not given an opportunity to dispute the debt. The woman to whom I spoke said I should have received paperwork and been given 30 days to request a hearing. She said she would send the paperwork and stop the garnishment immediately. I wound up having to hire an attorney to get the garnishment stopped, the attorney requested a hearing by telephone, we both waited in his office for the call but none came. More of the wonderful laws passed making student loan collections a billion dollar industry, whether anything is actually owed on the loan or not. The loan in question had been for less than $3,000 and had been repaid. At no time did it appear on any credit report from any reporting agency, and I found later that someone had altered the amount on the original loan document which made the loan invalid.
I firmly believe these collection agencies contracted by the Dept of Ed, deliberately search for loans that were for relatively small amounts and are more than 10 years old. Ten years is the time when it becomes nearly impossible to obtain bank records, assuming the bank still exists. I also believe they search for loans made to attend vocational/technical schools as most of those go out of business within a few years. The student loan laws were changed so that there are no statutes of limitations, the Dept of Ed and/or its agencies, contracted and otherwise, do not have to prove you owe anything; you have to prove you don't and until recently when a legal textbook on student loan laws was published, the regulations of the Dept of Ed were nearly impossible to find.
When this garnishment began, I had owned a house for several years, had the same job for 7 years, paid taxes, was listed in the telephone book and my credit score was 805. Why else would they have waited so long to try to collect from me?
I so wish that an attorney would file a class action suit against the Dept of Education as this has and is happening to tens of thousands of people in this country. I have been searching for an attorney to file suit on my behalf for several years and have yet to find one familiar with student loan laws.
