Our firm´s lawyers and tax advisors are committed to excellence. We love to assist our German and international clients and do our best to help them reach their goals by providing quality legal and tax solutions. Indeed, since our firm´s inception in 2006, it has been a great pleasure for me to serve this firm and its team of experts as its managing partner – day in, day out. We have achieved a lot over the past years and today WINHELLER enjoys a reputation for excellent work products, reasonable fees and great service in the German legal market and specifically in the areas of law our advisors specialize in.

But wherever people work, mistakes happen. If mistakes occur in our firm, we talk with our clients and try to fix what went wrong. And what happens when people talk with one another? They will usually find a solution for the problem that satisfies everybody. If we talk with a client who has a complaint, we will listen and try our best to fix the problem. Doing so helps us to learn from experiences and to better serve clients´ needs in the future. I think this approach makes the difference between bad and good service providers. We work hard to be among the good ones. In any case, we never had to make use of our malpractice insurance so far which, I think, proves that we strongly value trustful and reliable client relationships.

Of course, I would love to comment on the complaint at hand. Yet, I have a hard time replying to an anonymous disparagement. Since we believe to know who wrote this complaint, I'll gladly elaborate upon it: Litigation in Germany can be successful only if the plaintiff is able to prove that he has a claim. If there is no proof, the client will lose the case. It is that simple. So, we started the case out of court and sent a cease and desist letter to the opposing party, based on the information given to us by the client.

However, since the client did not want to provide us with the required proof we could not take the second step and go before a court. If we had gone, the client would have lost. I absolutely understand that the client was not happy with this outcome. However, it is unfair to blame us for this outcome if, at the same time, the client refused to contribute to a better result. In any case, I am convinced that we did everything we could in the given situation. I am sure that an independent third party would agree with me if said party knew all the facts and circumstances of this case.

Constructive complaints help us improve our services. I can assure you that we take them seriously.
