On March 6, 2006 myself and my fiance signed into contract for a trade-in of our vehicle ( which still had a lien holder on it) for a 2004 Jeep Rubicon. We were upfront with the salesman about our credit situation and that due to our recent move from NY to CO we were at that time 1 month past due on the trade-In's payment. The salesman contacted the Financial holder on the vehicle ( with us in his presence ) and inquired about the payoff amt of the truck. Our salesman than went and spoke to his sales manager, and after a lengthy conversation with him agreed to take our vehicle , pay it off, and purchase the Jeep on their lot, and assured us that everything looked good. The pay-off amt was for $13, 830.00. After spending approx 5 hrs at the dealership we were than escorted to their finance dept while the salesman went to another lot to pickup the vehicle we were financing. We sat down and signed every piece of paper known to complete a purchase of a vehicle, and were given the bill of sale, and the contract stating when our first payment was due, and for the length of 72 months. Finally, we were finished and left with the vehicle. Approximately, 10 days later I received a phone call from finance asking us to call him. In which I did, and was told if we could get another co signor to go on with us. At this time I reminded the gentleman that we were new to the area, and the only person that might be able to assist was my fiance's uncle. We sent him the paperwork, and he looked it over and called us back stating that the deal was already done, why was his info needed, and would not proceed with doing anything further. We notified the dealership of his findings, where the dealership was almost speechless, and asked again to try to find someone. By March 23 approx between 10pm - 11:15pm we were woken up by our dog to go out, and at that time we discovered the Jeep was gone (with our belongings inside). We contacted the dealership, and they confirmed that they did put our vehicle out for repo, never notifying us or asking us to bring the vehicle back so that we may claim our trade-in. When I did inquire about getting our belongings, and our other vehicle so that we would have something available to drive to get to my fiance's dialysis treatments, and myself to work. I was told by the Sales Mgr, that the truck was there, but was being picked up for repo by the other finance company, and he could do nothing further. We are now without a vehicle, approx 45 mi from the middle of nowhere, with no alternate means of transportation to and from dialysis, and I have since LOST MY JOB, and any future earnings. I spoke with the AID division and was told that this was not a form of deceptive trade, since they did not sell my trade-in, it was merely repo'd, and would not stand a chance in regaining the Jeep back. I however believe that we were due to to the fact they gave us all necessary paperwork to register and insure the vehicle, and stated to us that we would be financed. Why would they waste there time going through all of this for nothing. We did not even stand a chance of making payment arrangements with getting our trade-in back from them. Even a local attorney seems to think we were " set up". FYI This incedent has been labled as a "YO YO" Transaction and "Spot Delivery" - beware of these BS artists, new owner at this company, same old stories - BTW this company also runs S.Academy Nissan.
