well i got a loan from World Acceptance Corporation.i made my payments on time every month.well my JOb cut my hours,and i fell into hard times. now for the good part abput this Company. i offered two Partial payments to make one payment towards the middle of the month. the manager told me (NO) we can do not that and mailed my check back to me. i said okay.i got a payment for them gave to them now they added 20$ more to the payment. now this makes it a Partial payment again we CAN not ACCEPT Partial payments,back to square 1!


so i tryed to get caught be after they refused my partial payments due to the late fees i could not afford to pay. next thing i know i am going to court over this. i tryed to argue in court but i lost the case. well now they did a pay Garnishment aginst me.


i am fine with that.well friday 3/19/10 was suppose to be the last Granishment for 42.41$ they end up taking 120.14$ the human resources lady at my  JO told me she has to Continue taking 100$ a week until World acceptance Corp sends her the release to stop taking money!  NOW is this legal once they got the total blance owed?/judgement amount. to keep taking money? will they have to pay me back for all extra money taken after the blance was paid in full?  the Manager


was unhelpful towards me he was rude,and told me il send the relase when i am good and ready to teach people like you a lesson to pay back what you owe.i said are'nt you in violation of the law? the court paper work said 1020.14$ its been paid back and then some.by law do they have to give m back the extra they took from me?


any help how to get them to give my JOb the release of this Granishment.


now i am back on 40+ hours a week. any one i can turn to for help?

Up until the part of the garnishment there is no RipOff.  You failed to meet your obligation and they got a judgment against you.

So now we are up to the last garnishment.  Your employeer is correct, they can not stop the garnishment until they get a release from the courts.  If your employer did stop the garnishment before this they could actually end up in jail. 

Unfortunatly this takes the company to file with the court and the courts to send your empoloyer the notice to stop the garnishment.  They are sometimes quite slow and depending on how often you get paid this may take a couple of pay periods to do that.  However, if you did overpay they are required to return it to you.  If they don't return it you can go after them in court..talk about turning the tables on someone.  For this small claims works quite well.  If by chance they are doing this maliciously(and it can be proven), they may be in violation of the court order themselves and could face legal action against them.  Mainly if there are laws that give the company a set amount of time they must file the release after the judgment has been "satisfied".

The only thing you need to check on in your judgment is if they are allowed to assess interest on the unpaid balance.  This is quite standard in judgments and could explain some of the extra amount you are paying.  If they are allowed interest you need to figure that into your calculation of the total amount they can garnish.

Yes, they DO owe you the money they collected ABOVE the court award.

Further, YOU can now sue them in court for the monies they took that they were not entitled to.

I would contact the clerk of the court that granted the judgment and GARNISHMENT order and inform the court that they have deliberately taken EXTRA MONEY from your pay and that when you contacted them they REFUSED to send your employer a notice that the judgment has been satisfied and to STOP the garnishment.  They have a duty to inform your employer to stop the garnishment in a timely manner.

The clerk of the court should assist you; either by calling them or assisting YOU in filing a suit against them.

Do not blame your employer-your employer is caught in the middle and must follow the terms specified in the garnishment order.  If you can show the clerk of the court your pay stubs that show the judgment is satisfied, the clerk may be able to contact your employer to STOP the garnishment.
