I registered with the site www.createmytattoo.com and created a contest for users to draw tattoo ideas for me and I would pick on and my $400 deposit would be the prize for which ever tattoo i picked. After the 7 day contest was over a lot of artists said they hadnt been able to finish and they asked me to ask the owners of the site to extend the contest. I asked them and they allowed it and the contest went on for an extra 7 days. No new designs were submitted so at the end of the contest I told the site owners I did not wish to choose a winner and I would like my deposit back since I could not choose a drawing that I liked. They told me the terms of use state that all requests for refunds had to be requested within 7 days of the end date of the contest. And since my contest was extended that was pretty much impossible unless I requested a refund before the end of the extension. I emailed them a few times back and forth and they kept saying this same thing and sending links to their terms of us and user agreement. I told them it didnt matter because my contest was extended so the 7 days after the contest couldnt apply to me. I went months with out hearing from them so I decided to email them yesterday and they responded and said they sent me 4 emails saying I needed to choose a winner and since I never did within the 30 days the gave me my deposit is lost and the contest was closed and deleted. Basically they get to keep my money and I get nothing. I told them I was contacting my lawyer if they did not refund my money and that I would not come for my $400 I would come for $400,000 and that did nothing but get another email linking to their terms of use and user agreement.

Well I'm on a different side of the same problem. I acquired 3 commissions for this company and haven't receieved any payment even though they are promised to be delivered at the beginning of the month. This is now month 2 that I haven't received my payment and am owed 85 dollars. This is extremely frustrating and it makes me sick that they have no problem stealing from people who are giving them business.

Before I start, let me comment that this message has been written with a smartphone and thus many typos may be present.  I just wanted to mention that I myself am a real life artist and had tried going thru this tattoo website to submit my work to a few contests.  This customer clearly just admitted he did NOT want to pick a winner, despite his contest running over 2 weeks.  I'm sure he doesn't realize the ridiculous amount of man hours (human labor) that he essentially received for free via the goodwill and means of this website.  Since I design for a living (here in the USA) ,and know what my time is actually worth, I made the decision shortly after donating my time to several contests that had people much like this person on the end of the rope who essentially had absolutely no idea what exactly they wanted but wanted to gleam ideas or steal finished concepts from the artists by means is this site.  Unfortunately many of these artists on the site have donated countless hours to people like this consumer , meanwhile the inconsiderate consumer decides he wants to cancel a contest?! The very idea is repulsive and absolutely makes me sick to know there are people out there with no respect for the creative minds (they obviously lack) and human labor poured out for his (the costumer's) entertainment.  Just my two cents on the matter.

We kindly ask that you read this response in its entirety.  For the past 5 years our team has strived for nothing less than 100% customer satisfaction.  Our goal is to provide every customer with the perfect tattoo design or immediately refund their money in full.  Our community of over 11,500 artists has successfully completed thousands of tattoo design requests.  The most recently completed 5000 design request can be viewed on our website along with over 300 customer testimonials.  All of our current, past and potential customers can contact our 24/7 customer support via our website and we will be happy to answer any questions you might have regarding this report, our refund policy or any other aspect of our service.

We have made every effort to resolve this issue with this customer.  To the best of our knowledge the issue has been resolved.  On 8/26/2012 we sent a complete summary to the customer w/ all the dated email correspondence, receipt of the payment to the winning artist, a link to the customers design request (shown below), and the final high resolution image of the selected tattoo design.  We did not receive a response to this email or our follow-up email on 9/3/2012.
There are several points in the customers report that are not accurate.  In the customers defense, this report was submitted before we had a chance to provide him with all the documentation.  We would like to clarify the following points and have provided proof of these facts with links below.  We have 100% complete documentation of all the point available upon request.   Please note the following facts:


  1. Customer created a tattoo design request on Jan 31st, 2012

  2. A 7 day contest extension was requested and granted on Feb 16th, 2012

  3. The design request received 16 designs for the customer to choose from (see link to customers contest below)

  4. Final (of 4) email notices were sent to his AOL email account on Mar 7th, 2012

  5. Customer acknowledged that he made his CMT account with a different email address then what he normally uses and did not see the 4 reminder emails.

  6. On Mar 24th 2012 the winning tattoo was selected.

  7. Final design was delivered to customer & payment was issued to the artist Mar 31st 2012.  The final design is still available via the website today.

  8. Customer contacted our company requesting a refund on June 30th 2012  (over 100 days after the final notice was sent).  Our terms of service clearly state that all refunds must be requested within 30 days.  This policy is in place because we are unable to retract a payment to the artist after 30 days.  Please note that our company does not employ or get paid for any of the tattoo designs.  We simply provide the service of connecting artists w/ customers.  The payment goes to the artist after final designs are provided (which they were).  We have a PayPal receipt for the payment transaction to the artist.

  9. On Aug 26, 2012 the customer was provided the complete documentation pack including a high res copy of the final tattoo design, receipt of the payment to the winning artist and a link to the completed design request (see links).
