I knew I would be ahead a time due to one of the other renters in the Home Share situation. I had no problem with that.
Yolanda and her husband Ernesto had one of the other renters deliver their Rental Agreement to me:
Everything was fine until I got to item number 4 in the agreement which states:
4. ALL TENANTS RESPONSIBLE: By signing this Rental Agreement, each of you agrees to pay the rent and obey this Rental Agreement. If signed by two or more Tenants. each of you is liable for all the rent and for obeying this Agreement. EACH Tenant is also Responsible for other Tenants and guest and make sure they obey.
This is where I have a problem. By signing an agreement if any of the other tenants decided to not pay or move: I could be liable for more of the rent: Not just my own portion of it.
Yolanda Anacleto became very heated on the phone when I told here that this was Not a standard Month to Month Agreement and I told her that I had no problem signing one and send it to her, that I would not be responsible for any ones rent: Just my own. When I told Yolanda that I knew this wasn't a Standard Agreement: She Laughed. She told me that she had been doing business this way since 1976.
The next day: I received a registered letter in the mail: giving me 45 days to terminate THE RENTAL AGREEMENT THAT WE NEVER HAD TO BEGIN WITH. PURSUANT TO THE HAWAII LANDLORD TENANTS CODE.
If you by any chance decide to move to Hawaii and run in to Yolanda or anyone with so little integrity, make sure that you read all agreements before you move in or have exchanges any money.
