ZMT BANKRUPTCY WILL RIP YOU OFF. THEY WILL NOT PRODUCE THE DOCUMENTS AS GUARANTEED IN THEIR CONTRACT NOR DO THEY HAVE AN ADDRESS OR WILL NOT PRODUCE A PHONE NUMBER. Thank you for your insight. I have in fact added this onto the Chapter 7 forms this weekend. From what I have found on ZMT is that they are apparently operating near the GAZA Strip! That right, Israel. This would account for refusing to give any information about themselves. I have hired an attorney as well.

Your best option, of course, is to hire an attorney to handle this for you. Given that you are filing Chapter 7, that probably isn't an option. So the easiest thing would be to simply write a letter to the court and the trustee, giving them the details of your situation.


I would just address the court letter to the court in general. The clerk should be able to make sure it gets to the appropriate judge. Here are the addresses for the bankruptcy courts in Oregon (I'm not sure which one's geographical jurisdiction you are in, probably the one that's closer to you):

If you can't get the bankruptcy court to demand a refund for you, you can also consider filing a small claims suit against them in your local state court. From what you have stated, it sounds like you might have a breach of contract case.

ZMT would not allow enough time to finish including all creditors. I was unable to log onto their website and complete the necessary information. ZMT would never forward a phone number nor an address. Each time I tried to contact then, they would send the incompleted chapter 7. I will gladly pass this onto the court.

This is a bankruptcy petition preparation service, not a law firm, correct?

Which documents did they fail to produce or complete?

I ask solely out of curiosity. It seems odd that they would fail to produce all of the completed forms required to initiate a bankruptcy case. They likely use software that completes all of the paperwork for them. All they need to do is some data entry.

But there are a few items in the bankruptcy schedules that a petition preparer can't complete (such as the portion of "Schedule C" where a debt is to be categorized as "liquidated," "unliquidated," or "contingent" - these are legal conclusions that have to either be determined by an attorney or the debtor himself).

If they did in fact fail to do what they were supposed to do for you, you can petition the bankruptcy court for a disgorgement of fees (in other words, you can seek a court order demanding that they refund your money).

If you are still in the process of filing bankruptcy, there is an item on the Statement of Financial Affairs that asks about fees paid to bankruptcy petition preparers. The $189 would have to be reported there, and the trustee is going to be curious as to why that money was paid when no petition was produced. If the trustee feels it is warranted, he/she may seek to recover the funds. So your issue may automatically resolve itself via the bankruptcy process.
