I embarrassed to admit that as an AC contractor, I once accepted HVAC service calls from Choice Home Warranty. Let me start by saying that Most Home Warranties are scams. The contractor does not get paid and the home owner gets their claim denied. I could right a book on Choice, and will continue to update this report. What you need to know is that in the state of Texas there are 3 regulatory bodies that deal with home warranty companies; they are the Texas Realtor's Association, Texas Department of Insurance and the Texas Department of Licensing and regulation (TDLR). The entity that has precedence is dependent on how your bought your policy. However CHW is illegally doing business in Texas, because they are only registered with the Texas Realtor's Association. I will be putting up a web site with forms for the proper agency soon, to help stream line complaints against CHW with the intention of getting them barred from doing business in Texas. Keep checking back and always make sure the Attorney General of Texas receives your complaint.

CHW has already been barred from 5 other states by those states attorney general and is under suit for 300+ million dollars. As most people already know, the state of New Jersey where CHW is based is a corrupt state, so they will always be able to operate in New Jersey.

CHW is probably responsible for elderly deaths and injury in Texas and you should be on the alert for heat stroke victims who had their claims denied. I serviced an elderly lady's home in Richardson,Texas who was living strictly off Social Security. Her compressor went out and I instructed her to gather her prior years service documents before calling the CHW or they would deny the claim based on lack of maintenance. When CHW could not find a legitimate reason to deny her claim, they told her they entered the claim into the computer and the computer denied it; they did not know why. Can you imagine how many elderly people have been injured by CHW. I can tell you from personal experience that when the claims department finds out your poor, elderly, black and sometimes female, your claim will be denied.

This is how the claim process works at choice; they ask the contractor a series of questions. Is the condenser dirty, is there vegetation growing next to condenser, is the air filter dirty, is the evaporator clean, is the system properly sized (big or small) and is the system up to code. If all this checks out then the home owner must provide previous years paper work showing a licensed AC guy maintained the system and found it to be in good working order. The problem is that most systems won't meet current codes, because the codes are updated annually and most systems weren't installed according to code. I have been in 2 year old homes that are 4000+ sq ft and don't meet code.

CHW is in violation of Texas state law according to the "Texas Occupations Code Chapter 1303 Residential Service Companies".
