i was summoned in jan. of 2007 that i owed 2,000 something dollars for a credit card i had with emerge visa. i don't recall it being that much before i stopped useing it and i don't recall them (emerge) ever contacting me about the debit. i did however write them a letter saying i did owe that company and that i would like to set a payment plan. however they never contacted me. so far they have garnished two of my checks i'm unsure of how they got my employer info. what exactally can i do even though they have started doing the garnishments of my checks? any info is helpful.i've tried to contact them before i started getting my check garnished but was never ever able to reach any one on the phone always got avoice mail. at one point i was sending them something ever two weeks to every 1 week. please help .

In order to garnish a paycheck, there has to be a judgement against you. A collection agency can not just take money out of your pay.

There are a couple of opitions here, you can petition the court for hardship or to lower the payment.

Their only allow to take of certain %, of your pay

Marie,

When you wrote that letter to them, that was all they needed, You agreed you owed the debt, and they probably went straight to the court and obtained a summary judgement.

If you ever paid them by check, they had your banking info, and if you have direct deposit at work, the employer info is readily available.

This is why you NEVER call or speak to any debt collector on the phone, and NEVER admit to anything.

The entire legal burden of proof is on them.

At this point YOU NEED A LAWYER. Hopefully the account was past SOL when they initiated legal action. If this is the case, you can get the judgement vacated, and get your money back., less what the lawyer costs you.

Close that bank account immediately and open one at a DIFFERENT bank, and if you have direct deposit, stop it and get a paper check. Then cash your check at a check casher and deposit cash in your new bank account until you get all of this resolved.

If your job is not that special to you, quit and go get another one. This will throw them off your trail for awhile and they will have to spend more time and money to do it all over again.

It all depends how serious you are in not paying them.

Keep in mind that the original creditor is most likely out of the picture, and a JUNK DEBT BUYER is the owner of the debt, who paid far less than a penny on the dollar for it.
