These people sent a notice to our address with a false name claiming that money was owed in the amount of $1,271.00. I made the mistake of calling their 800 number and confirming info that I shouldn't, normally I am not this stupid but I just got so mad at the idea that someone was using that I made the biggest blunder of all. I also looked them up on the WEB after making that call, another huge blunder.

Quick question. You say that the letter was under a false name. Was the false name who they were looking for, or who the collection agency is?

If the collection agency is listed as a false name, under what name were they listed. If they did not list under their name, they would be in violation of the FDCPA.

If the letter was under the name of a different person, why did you open it? If the letter is not addressed to someone in your house ( or at least under a maiden name of someone in the house), don't open. It is not yours.
