I received a call from a Tim Hutchins claiming to be a representative of Bank of America who was attempting to collect a debt.

Actually, he called my husband first to tell him I had committed fraud by using his name to open an MBNA (sold to BOA) account and then charge up to $105,000 fraudulently. He told my husband he was about to send the account to arbitration.

My husband, angry and upset called me and had this Tim guy call me too. I called Tim Hutchins back and he repeated that I had opened a fraudulent credit card using my husband's name.

Then he told me I could settle the debt for about $10,000 less than what was actually owed. He had my credit card information and was very rude. He told me if I did not do as he said, he would hang, up, call my husband back and tell him I was committing fraud against him.

Do not listen to these people. They violate the Fair Debt and Collections Act. Speak directly to the bank and get written confirmation that they are actually representing the bank.

Make sure if you do any business with these slimeballs that you get everything in writing, including the settlement letter. Under no circumstances should you deal with them over the phone, they will upset you to no end. I quit talking to them at all and would only deal in faxes which are written proof of the communication. These guys have no scruples and apparently accuse everyone they talk to of committing fraud.

If it is the Bank of American calling you directly, they can pretty much say what they want. Bank of America would be considered a first party collector, so the Fair debt collection practices act would not affect them.
