We contracted with E-Z Movers Inc. of Skokie, Illinois, ICC 68109, DOT 692922, to move our household goods from Chicago, Illinois to Ladera Ranch, California in September 2002. When the goods arrived, we discovered that many items were lost (stolen?) or damaged. We filed a claim on November 1, 2002, for approximately $6000. Although our claim was acknowledged on November 5, 2002, and assigned a claim number of 500803, the claim has never been resolved.
Despite numerous letters, emails and phone calls, this claim remains open. Furthermore, while this claim was opened on November 1, 2002, we have never received any notices as to the status of this claim and the reasons that it remains pending. As you know, E-Z Movers is required to pay, decline, or make a firm settlement offer within 120 days after receipt of a claim or advise us in writing of the status of the claim and the reasons for delay in making a final disposition. See 49 CFR 370.9. Moreover, E-Z Movers is required to provide written status reports after each succeeding 60-day period while the claim remains open. See id.
Our claim has now been open for more than 448 days. Accordingly, by my calculations, E-Z Movers has failed to give us six status updates, all in violation of the regulations.

I am the Attorney for EZ Movers. Mr Campbell is also an attorney. Without getting technical, there were specific legal, contractual defenses asserted by EZ Movers which Mr. Campbell disagreed with. In any event, the claim was settled, Mr. Campbell has been paid the stipulated settlement amount and Mr. Campbell has executed a complete, written release.

contact THEIR insurance

Find out the company that EZ has their insurance through, and contact them directly. Maybe EZ hasn't even forwarded the claim.
Spend $100 to have a lawyer write a letter on the firm's letterhead, demanding the requisite "claim pending" information sent to you and resolved, or you will institute legal action. Have you contacted all the authorities (go to this report for the list of contact info: http://www.ripoffreport.com/reports/ripoff69346.htm), including Attorneys General for the states involved? Try the Economic Crimes division, or the equivalent.
According to the Chicago BBB, they have been fined for this in the past, so the DOT knows about them. (http://www.chicago.bbb.org/commonreport.html?bureau=chic&compid=38005486&code=) Send in your own complaint, if you haven't already done so.
