I ordered 5 locations at a price of $45,990 back in the first week or May 2006 after visiting their office and meeting with Andrew, Stephen Duffie and Anthony Benvenuto. I was very encouraged initially as we all were. I even worked for as a locator for them for a short while here in Orlando and landed a couple locations for which they compensated me as agreed. The locations did not meet my standards, but they met theirs so I did not keep them for myself.
I quit locating for them because they did not furnish me the locations as promised and I became very suspicious. The 1st location they gave me within a few weeks. The rest, I had to call and call everyday all summer to get them to finally hook me up during the end of August with my last 4 places.
During this time I considered calling the authorities but reasoned that I would never get my locations or my money back if I got them shut down. So I remained patient and cordial with them and I think this is why I received my locations and others did not. After I received my last locations...THEN I chewed them out.
Anyway, the first location makes me money...about $350 a month on 9 transactions a day. Another I made me about $80 last month. 2 are barely used. The 5th machine sits idle in the location because the store owner decided after the machine was placed that he did not want to pay for the phone line in violation of the agreement. So I'm working with him on that. After I threatened to sue him for $9300 plus legal expenses he agreed to order the phone line, which Fidelity agreed to pay for but never did. Still, this was not in the contract.
Anyway, the point is, I make just enough on the 2 profitable machines to pay UCS the service fees on the 3 which have virtually no business at all. So I break even.
Since Fidelity is not able to fulfill the guarantee, I feel I should be entitled to compensation, if not a full refund. I would be happy to collaborate with any of you who might like to organize so class action suit.
If anyone has any ideas of how to use the FTC to get us compensated please share.
