After reading this other report I am convinced. I recieved a letter as well saying that I owed 876.00$ from our last apartment. I called and had to leave a message. Then I called again and spoke with Andy Glen. He too told me what a bad person I was that we had left the apartment "filthy" and "skipped out" on our bills.
When my husband and I left we were in the process of getting a new home then I left my job due to personal reasons and our loan for the home fell through, by that time we had already left the apartment because we couldn't pay rent and down payment for the loan.
We recieved a notice from the landlord to pay rent for November of vacate the premises. We vacated. I will admit the carpet was not the best shape. But we paid our deposit and a pet deposit. When I tried to talk to him to work out payment he said it was already sent to court and unless I could pay in full that he wasn't a payment agency, and belittled me some more. Since this is the first letter I have even recieved I am convinced this is some kind of scam.

I read the rebuttal ,our lease was up, it was month to month. We recieved a notice from the landlord to vacate the premises by a certain date or pay the next months rent as usual . We vacated by the date set. Normal ware and tear, less two doors damaged. Carpet original condition not good very stained, however my dog did chew 3 holes in it. But they kept our deposit and our pet fee. Which was almost 1000$ altogether. But I will contact that association for further investigation. Thanks.

How many more months did you have on your lease?
did you give him a 30 day notices, when you were looking at this house?
how old was the carpet? was it a new carpet when you moved in? or just cleaned?
you have what is called normal wear and tare anything beyond that you have to pay
did he keep your security deposit? That should of off set some of the damage
if it's been more then 30days, and you gave a forwarding address or he knew where to fine you
he is required to give you a statement of all repair and what they cost. if not he is liable for double damages with your security deposit
Does he have photo's showing the condiction of the place after you moved out?
a landlord has a duty to minimize his damanges, and what alot of lanlords do in the Tampa bay area, is take there time getting the place ready to re-rent, and expect you to pay th whole thing, or what's left on your lease
if this is a collection agency, in writing (RRR)
demand a full accounting of all the charges and how they came up with that amount and all receipts for the repairs, computer receipts are not acceptable, look at the dates of everything they send to you and they should be within the 30 days of you moving on the repairs
Contact the landlord & tenant assoc. there free and can give you the best information
I'm not an attorney,
If i remember correctly Chapter 83 of the Florida statute cover landlord/tenant laws, google that and read up on what is permitted and your rights
Last question why is a collection agency's doing this? a landlord can file in smalls claims court and get (if) any money is due faster. and is the collection agency's trying to add charges?
