On 1/15/09 I placed an order online w Twister for an HDTV converter box with valid govt coupon worth $40 toward purchase price. I carefully filled in all the coupon info into the boxes presented. Day of coupon expiration was not prompted by Twister--just "mm/yy." Expiration date was 1/21/09. On 1/17, Twister said I had logged insufficient coupon info. Distracted, I briefly suggested they send the unit without coupon, but within 3 hours, reclaimed the coupon and all its data, this time including the day expiration. This was late on 1/21.

Twister disregarded both my original purchase application and the coupon reclaiming, preferring the 3 hour confusion, and thus billing me full price, disallowing the coupon. And, of course, they claimed they could no longer redeem the coupon because now it was expired. In back & forth emails, they insisted that the only one of the 3 order attempts they would honor was the "without coupon" middle one. And they insist that they can't ask for govt reimbursement after date of purchase. But I know they have 30 days to bill the govt agency! The paperwork for the purchase date is well recorded for the govt, as 1/15 and/or 1/21.

This would be a perfect way to double-bill both me and the govt for the same $40! I know this exact thing has happened to others. I've read the reviewswhich get mysteriously deleted.

The Coupon Program Final Rule 301.6(b)(2)(F) states that "Retailer agrees only to accept coupons for, and receive payment resulting from authorized purchases made for CECBs." This means that retailers can only redeem coupons as part of an authorized purchase made for a CECB.

A "post-sale redemption," when a retailer exchanges a coupon for payment after the purchase transaction rather than as part of the purchase transaction, is prohibited. This means that if a consumer returns to a store with a coupon after having purchased a CECB without a coupon, the retailer may not provide the consumer $40 in exchange for their coupon.

The order #185199 was entered on 1/15/09 with incomplete coupon number: 12 digits instead of 16. We sent a message to the customer inquiring about a coupon. His reply on 1/21/2009 5:52 PM was: Never mind the coupon. Please send the order without one.

Then on Jan 21, 2009 10:33 PM he wrote:
Disregard previous message today from k-wilde about sending merchandise without coupon. My coupon is good through 1/21/09, and needed.

Please note that full 16 digits coupon number was still not provided. And that message was sent at 10:33 PM Mountain Time. That was 33 min pass midnight on 1/22/09. The coupon has expired and we didn't even have its correct number!

The order was shipped. On January 26 all of a sudden the buyer is requesting to apply his coupon which has expired at that time:
You have incorrectly billed me (01/22) without crediting my valid gov coupon (Order ID 185199, 01/15/2009). Please credit my account $40.00.

Further message from the buyer:

OK. Now about the billing: My converter box coupon was eligible when purchase was ordered (1/15). That can be tracked. There may have been some temporary confusion about the registry of my coupon, but I cleared that up before expiration date (1/21). That can be tracked. I must insist that you apply my valid coupon to my purchase by crediting my VISA $40. The applicable law says "Payments from (NTIA) program funds to retailers will be accomplished in a commercially reasonable manner." (Dept. of Commerce National Telecommunications and Information Administration 47 C.F.R. 301, RIN 0660-AA16 Final Rule, II G, Retailer Participation, f. 124.) Further, in above f 122, retailers (i.e., you) have 30 days to present coupons to Govt for payment. You can still bill the Govt, and I will expect no less.

First of all, "Govt" can be billed only for authorized coupons. No coupon can be authorized after expiration date. If a coupon was not authorized, it will not be paid for.

Recently we received paperwork from the credit card company. The charge for the converter box was disputed! Can't find a different word for such action other than fraud.

Further, we never billed anybody twice for coupon AND on credit card. All coupon values are deducted from order totals. Without proof that may be considered as libel. We have conveyed all this information to NTIA.
