Received cold call from Joe howser on 12/8/2011 inquiring if we had any outstanding receivables. I told him we do C.O.D. only and we had an issue with our customer not being able to pay for the product on our agreed delivery date. Joe replied that they could help and even looked up our customers credit history. He told me that they were very risky and I should act immediately. I agreed, he then sent me the contract with an incorrect name. After telling him the name was incorrect he re-sent the contract but never required a signature.

They immediately began to harass my secretary while were were in the midst of doing payroll, demanding the information right away as if she had nothing else to do.  When she was done with payroll she sent them the info. Tucker albin then called my customer and attempted to arrange a solution. Tucker albin then called me and said the customer was ready to comply and would accept shipment on the week of the 12th. I explained to tucker albin that we shut down the entire facility on 12/23/2011 until 1/03/2012 for Christmas and new years. I also explained that we were already behind schedule and it was going to be difficult to ship all the product to our paying customers on time. They said they understood. A few days later I received a harassing phone call from another tucker albin associate informing me that I was interfering with their attempt to collect, he was
extremely rude, so rude in fact that I hung up on him. He called back and I explained to him that HE was interfering with my business and that I couldn't send one of my delivery trucks to deliver to the customer who originally couldn't pay without delaying the shipment of one of my customers who were in good standing.

On Friday the 23rd of December, after we had our employee Christmas party we shut the facility down about 12:30pm. On 1/4/2012 I received another harassing phone call from tucker albin telling me that I breached the contract for client interference and I had to pay $466.29 that SAME day or they would file suit against me and my company. He also informed that what I did was indeed a felony in the state of Texas and they do this stuff for a living. He then hung up on me. Obviously not wanting a felony I paid them that day. He then said thanks and I won't be receiving any more menacing phone calls from them.

Problems resolved amicably

I was contacted recently by Allen Humpris the CEO of tucker, albin. He assured me that they have made many changes to the company in order to avoid any similar problems in the future. Thankfully we were able to resolve our issues amicably.

Better business bureau rules in my favor

You have indicated from your Customer Response that you were not satisfied with the Company Answer in your complaint case. Because of this, we have conducted a case review which includes all of the available documentation
contained within the Original Complaint, the Company Answer and the Customer Response.

Based on this review, we have determined that the company did not do all that it could have been reasonably been expected or been responsible to do to resolve the issue. This case is being closed and will be reflected in our files as Unresolved.

If you wish to pursue the matter further, you have several options.

1. You may be able to sue in the county Justice of the Peace courts, commonly referred to as Small Claims court. You will need to determine the county in which the company is located and call the county seat for more information. Or, check one of the online search engines to see if your county has a web site, which may provide helpful information on how to file a suit.
2. You may consider hiring an attorney to assist you. If you do not have an attorney, you may call the Dallas Bar Association Referral Service at 214-220-7444 for assistance.
3. If the company requires a state license from a state agency, you may be able to file a complaint with that agency. If you do not know if a business requires a license, you can access the State of Texas web site State Agency link at http:///www2.tsl.state.tx.us/trail/agencies.jsp to inquire.

Unfortunate

It is unfortunate that Best Fabrications Inc ("Best") of Bartow Florida decided to post frivolous pleadings in this public  forum.  They have attempted to file the same claim with other entities, but to no avail.

Tucker, Albin & Associates Inc ("Tucker") is a collection agency that collects solely upon business to business debt.  We do not collect upon consumers, only commercial debt.  Best executed a contract for services with Tucker that contained specific terms.  Best then placed a claim for collection against one of its business debtors.  This debtor had special ordered product that was not delivered to them by Best.

What Best is failing to provide the public eye in this matter is that Tucker immediately initiated collection activity upon that business and secured an arrangement to resolve the balance owed to Best.  As part of this arrangement the debtor expected its product to be delivered to them and only wanted to know by what date that product would be delivered.  Once they had the tentative date they were going to make payment to our office on behalf of Best.

Tucker was contacting Best persistently to obtain this date that the product would be delivered to the debtor so that we could do what Best hired us to do, collect their receivable.  Best failed to provide a date, only making excuses like their offices closing over the holidays.  Despite Best being advised that the debtor does not expect delivery during the holiday, just the date after the office opens they would deliver.  Yet, Best continued to not cooperate in the process to resolve the matter.

Contractually Tucker is owed its fee for their service and Best is just upset that they did not get the money without being able to keep the product and is not complaining of the entity that did what they hired them to do.

Like the popular saying goes, there is always two sides to every coin and typically it is the person that goes around complaining about something that leaves out, skews, stretches or omits other facts; know somebody like that?
