USPS United States Postal Service USPS refuses to prosecute mail theft Nationwide

The same person who a postal employee identified as stealing my mail is now under investigation by the postal inspector for two more mail theft charges.  Maybe this time he will go to jail.

Tyg, I notice you rebutt other complaints on this forum even though you are not involved in the actual complaint.  You always blame the person filing the complaint, saying it's their own fault for the wrong done to them, alot like you did to me.  Did you ever consider for even a second that what I wrote was the truth?  That my mail was stole and the two avenues to get justice close the door in my face.  I get the local prosecutor plea bargin to get the case off his docket so he can move on to the hundreds of other cases on his desk.  I get it.  Did what he had to do.  I would expect the postal inspection service to step up to the plate and serve some justice for this crime against not just me, but against the post office itself as well. 

For you to accuse me of lying, of being a woman scorn, is unbelieveable.  For you to accuse me of wrong doing, of setting up an EX for revenge is outragous.  You don't know me or anything about me, but yet you came to your own conclusion that I'm a woman scorn out for revenge.  Really?  What if what I wrote was the actual truth?  What if I was frustrated that someone stole my mail which is supposed to be a "Federal Crime" and absolutely nothing was done even though the person who committed the crime was identified by a postal employee?  I wrote a complaint here in the hopes that someone from the USPS might see it and say, "You know what...we're going to take a closer look at what happen and see what can be done."  I know it's not the crime of the century, I don't want this person hung or beheaded in the town square.  I simply want him to pay for the crime he committed.  Whatever fine or penalty for the crime...he needs to pay it. 

For you to make accusations about my motives when you know nothing of me is so sleazy.  Do you really have nothing better to do then attack people, me as well as others in this forum, adding your warped opinion and accusing the complaintants of wrong doing?  You offer no useful advice, personal experience relevent to the complaint, or knowledge pertaining to the complaint.  You go on rants accusing people of lying, ulterior motives, and/or what THEY supposedly did wrong.  Who are you to do such a thing?  Grow up and get a hobby other then berating people for something you know nothing about.

First and foremost I must say while I do know the person who stole my mail, he was NOT an exboyfriend, close friend, or a relative.  I live in a subdivison and he is a local handyman who I've hired a number of times to cut my grass (I'm disabled and can not do it myself).  I NEVER had any dispute with him or was unsatified with his work.  I never felt ripped off by him, always happy with the work he did for me.   The mailboxes for the subdivison are at the enterance of the subvision.  My mail would get picked up at the end of the day by my daughter.who at the time was living with me. 

The express mail was a letter I was expecting from my great uncle who lives in NJ and I'm in NC.  There was a money order in that letter for me to pay a friend to drive to NJ in a moving truck, pick up furnishings from storage which belonged to my grandmother.  Part of that money I told the mail theft would go to him to help unload the truck when it returned with my grandmothers stuff. 

He know I was expecting this letter containing the money order.  The money order was cashed at a store (with no video security) about an hour drive from me.  Coincidently, the thief's father lives in that very same town as the store where the money order was cashed. 

Did my great uncle get his money back.  Yes, but I'm pissed that a theft happened and the thief suffered no consequences for what he did.  He FRAUDULENTLY obtained my letter from the post office by showing the card from my mailbox and signing my name to pick up the letter.  He stole the card from my mailbox to pick up that letter. 

Yes, I paraphrased Title 18 but also include a picture of that title so it could be read in full.  "Whoever steals, takes,or abstracts or by fraud or deception obtains, or attempts so to obtain, from or out of any mail, post office, or station thereof, for mail matter, or from a letter or mail carrier, any letter, postal card, package, bag, or mail, any article or thing contained therein, or secretes, embezzles, or destroys any such letter, postal card, package, bag, or mail, or any article or thing contained therein".

The postal card was stolen from my mailbox.  He then went to the post office and stated he was picking up a letter on my behalf.  Do I expect this guy to spend the rest of his life in jail for what he did?  Of course not, but I expect my mail to be safe and if stolen I would expect justice and for the criminal to pay for his crime. 

Did I paraphrase Title 18, did I leave out details in my original complaint in this forum...yes.  I just wrote what I thought were the main details of my complaint.  I didn't expect people to dissect everything and look for ulterior motives for my complaint. I pissed someone stole my mail and didn't pay for his crime. 

Just for the record:  I have never been arrested, sued or accused of a crime other then motor vehicle tickets when I was able to drive ( I no longer drive due to my disability).  The person who stole my mail:  Has numerous convictions for theft, domestic violence, resisting arrest, and arson.  I was told this by the police investigating my mail theft.  Send me an email and I'll give you his name and address, you can look up his criminal history for free online. 

Anything else I need to justify, clarify to defend myself for wanting justice?

First off it is very obvious that this was not some random stranger just walking down the street deciding to look in your mailbox.  This was someone you were very familar with.  So contrary to your warning, I don't think the people of the United States has to really worry about bands of mail thieves taking their mail and the Postal Servie not doing anything about it.

It is also very obvious that, to put it nicely, you despise this person with every bone in your body and would have been very happy if they were given life in prison for this "theft".  But there is what you want, and there is reality.

You mention Title 18, but convieniently "paraphrased" a very important part.

Whoever steals, takes, or abstracts, or by fraud or deception obtains, or attempts so to obtain, from or out of any mail, post office, or station.......

I underlined the one part that you left off and is probably your undoing.  If this person is familar with you and has a relationship, it is not that out of the ordinary to pick up others people mail.   As they say the devil is in the details, and you are trying your best to leave out some very important ones because they don't help your case.

Then as you stated in the penalty.

Shall be fined not more than $2000 under this title or imprisoned not more than fixe years, or both.

Again, notice the undelined part.  It states "not more than", which means that is the MAXIMUM one could recieve.  Depending on the actual severity and loses a judge could actually impose a $10 fine and no jail time and still be within the guidelines.  There is another part to this, your actual loss.  Again you didn't come right out and say it but it appears that your loss had little monetary value, nor did it cause you any damage(other than some emotional rage).  Where yes, this matters.  After all you can not expect the same penalty for a shoplifter who steals a pair of socks, and one who steals a $10,000 Diamond bracet. 

Now, as for the prosecution.  The prosecutors are not going to prosecute just to satisfy someone's desire for revenge, they are only going to prosecute if they feel they have a case.  They also again will balance that with the actual losses.  In your case they felt that the case was not strong enough.  However, this guy did not get off totally free.  He was up on 3 charges..remember.  Domestic Violence violation, reisting arrest and mail theft.  The prosecutors removed the two least severe crimes but did not drop the DV Violation.   Where my guess is that probably ended him up a lot more trouble than the theft of your mail.  So he may have won the battle of the theft of the mail, but he has probably lost the war.

But all is not over. If you still truly think that there is a huge miscarriage of justice..do something about it(and no I don't mean just writing here).  Talk to your Senators and Members of Congress.  Get them to stiffen the laws for mail theft.  If you think EVERY case should be prosecuted and EVERY conviction should end up with life in prision..then lobby your government officials.  Get petitions together, start a social media site.  If you TRULY believe this then take the reigns and change it.  

 Kinda funny actually that YOU leave out the YOU know this person. I mean why else would YOU work so hard? The reason would be that this person is more then likely an EX BOYFREIND. Meaning that you were probably living to gether which means that person HAS AN EXPECTATION to receive mail at THAT address. Meaning that while YOU THINK that this person should be prosecuted the reality is that as a EX that lived with YOU, that person has the right to check the mailbox. Meaning THEY HAVE PERMISSION!!!! Im guessing that doesn't matter to YOU. YOU just want to PUNISH that person for hurting YOU. Unfortunatly THAT IS FOR THE JUDICIAL SYSTEM AND NOT FOR YOU TO DESCIDE!!!! Its a PLEA BARGIN!!! A plea is normally done to allow the criminal to avoid a costly trial and settle for a LESSER charge. Or the DA didn't have a lot of faith in the case and used a plea bargin to ensure that person got jail time. YOU are out for Vengence yet YOU take NO RESPONSIBILITY for the situation.
