We have been customers of Wells Fargo bank for about two years. We are currently in the process of seeking out a more honest bank to switch our accounts to.

Wells Fargo has made it a habit of fabricating overdraft charges every month and in all has probably stolen more than $1000 from us by doing this.

They do this by "moving around" charges so that if we come close to "going over" they can charge more overdrafts by putting smaller charges towards the end.

They do this by charging Overdraft fees on the SAME day we make large deposits. They do this AFTER we have deposited the money; acting as though it was not yet in there.

They do this by placing a "hold" on our PAYCHECKS when we deposit them. Our PAYCHECKS!! They will not clear them until midnight that day or sometimes not until midnight the NEXT day. These are paychecks from known, reputable companies.

Despite REPEATED efforts over the years (ten+ times) of talking with a banking representative, they have only agreed to take off a charge ONCE. Most all of our phone calls to the bank results in them "talking down" to us and suggesting that we manage our money better.

This company is shady at best and does NOT have the customer's best interest in mind. We would very much be willing to participate in a class-action lawsuit, if anyone is pursuing one.

I would definitely recommend that people watch out for this bank and not let them get ahold of your hard-earned money like they have done to us and so many others.

You are mistaken Phuqued in regards to the state of Washington.  Washington not only deals with the largest withdrawal first, they take check deposits, and cash deposits last.  For example: If I deposit $200 cash at 12 p.m. on a Tuesday.  I then use my debt card to purchase something for $50, gas for $40, and food for $30.  The next day there will be 3 overdraft fees for $35 each.  I deposited CASH!!!  That is wrong in so many ways!!!

Feeling wronged

If feeling wronged by any financial institution you can always file complaints thru the O.C.C. (Office of the Comptroller of the Currency). The great thing about it is if you truly were wronged they have the power, time and money to deal with it for you. You can find their website at www.occ.treas.gov. But I would still recommend that you read all of your account disclosures at any financial institution. They don't have to give them to you verbally, just provide them to you in writing.

Their computer printout means nothing in a court of law! Direct deposits never go through instantly, that is what a wire transfer is for.

Direct deposits use the ACH system, so if their system is saying that it was transmitted on the 11th, it would hit Wells Fargo that night to be credited the next day.

My company's direct deposit works the same way. I released payroll today that goes in tonight to hit our employee's accounts tomorrow.


Back to the OP:

Holding your paychecks that long (heck, allowing them to clear the same night is above and beyond what the federal government requires) is 100% legal in the U.S. In fact, they *can* hold it a few days longer unless you're being paid by the U.S. Treasury.

You Got Bad Information Phuqued

Phuqued, the fact someone in the unemployment office told you your check was disbursed on the 11th doesn't mean it's in your account on the 11th or the 12th, and they did you a terrible disservice by indicating such and you ought to tell them that. There is generally at least 1-2 day delay for monies to be disbursed from any entity to the time it's actually available for you to spend.

Here's how it works:

The money is disbursed at end of day on the 11th, regardless of when in the day the person in the governmental office told you. Your bank is not even going to be notified of the deposit until the evening of the 12th. Since the 12th is a Friday, there will be no deposit activity to the account over the weekend, which means the money becomes available to you on Monday December 15th. So yes, in this case, it would take 4 days (2 business days) for the money to be in your account.

In a situation like this, it's a good idea to check the online activity in your account because it will tell you whether the money is available, or whether the transaction is still pending. When it is no longer pending, that's when it's available to spend. I sympathize with your situation - but that's how the system works.

wells Fargo Creates Overdrafts and I've documented it.

They do exactly what he describes and worse.
I'm receiving unemployment checks.

It was the 12th of December, while standing next to an unemployment service worker in her office as she looked it up on her computer, that I learned my direct deposit from unemployment services had been deposited in the 11th.

Later that day (the 12th) I went and purchased 3 items.Wells fargo charged me $35 x 3 in false overdraft fees.


I now have screen capture video of myself visiting the unemployment weekly claim staus webpage wherein it shows my direct deposit was deposited into Wells Fargo on Dec 11th, 2008.

I also have computer screen capture video of Wells Fargo online showing that
the same deposit according to their system was not made until the 15th.


After telling them I have proof from a government agency that the money was deposited on the 11th, and that I was going to make Youtube videos showing how Wells Fargo rips off the unemployed at Christmas time, they gave me back half my money, charging me only $17.50 x 3

Stealing my money and giving half of it back. That might have worked back when they robbed their little brother of his candy in grade school, dreaming of being a banker one day, but it doesn't fly with the rest of us.

And it doesn't seem to matter how much you tell them you have govenrment proof, they simply say "Our records show that the overdraft fee was valid" So how do argue with that? They know you don't have the money or time to take them to court over it.

They figure if you don't have $1000 in there at all times, you're worthless to them and they'd prefer to get rid of you. Ripping you off several times is one way to do it. If you stay anway, they learn you're not so worthless to them after all, and rob you fo $35 a week or more.

They've even quietly gotten together with fellow banks to make it common practice so you feel you there is no competition to go to, they're all the same family of garbage.

It's upper managment CEO garbage computer programming. And what is the little bank employee on the phone gonna do? He has to go by his computer screen and his records, but almost as if instructed, does not want to see your records.

They're hoping you don't have the time or resources to actually print out your proof and inch your way through traffic to actually go down there and show it to them. At which point they have some tin horn three card monty shuffle word game to try and explain away their deceit and "let you off the hook" by stealing only half.

I'd like to point out that as sneaky as they are, they have full time staff paid to monitor sites like (The Ripoff Report) and post rebutles as stupid as the one suggesting it's not the banks fault but that the Federal Reserve "Mandates" it.

That's odd because the "Federal" Reserve, though confusing, is but a mis-named private bank owned by a very filthy family, however they are not the government, in fact they don't care who makes the laws, in his own words, "Give me control of a nation's money and I care not who makes the laws" - Meyer Rothchild

So how can they be "mandating" anything? Or does that bank spokesperson posing as a poster and a human being, openily admit the misleading named Federal Reserve is illegally dictating laws of comerce?

So when you see over a thousand rip off reports about the same bank, on one website alone, and magically there are people whom have nothing better to do with their lives but pop in here (as if paid to do so) and tell the plaintiffs their nuts, well than you realize all those people are the same small group of paid liar spokespersons, for the criminal defendent bank.

Because any real bank employee, on their own time, hates their d**n bank just like the customers do. And they sure wouldn't be in here on their time off..
I had to be a furious victim before I'd spend an hour of my free time in here.

I don't want to hear lies here, when I was working I could (walk in the door) of this bank to despoist a $1000 pay check, and ask for half of it back in cash, and get it right there and then! ...with less than $100 in my account.

But you're telling me a direct deposit from a government agency will not be availabel to me for 4 days? And that's acceptable? As a matter of fact it would seem that it is not available to me until the day after I overdraft, whenever that may be!

So stop telling people it's their fault for using a Debit Card, trying to sell them a Credit Card. I see right through you and soon the whole world will. If there is any fault with the debit card it is because the bank makes it so, in hopes the owner replace it with a credit card, with a little coaxing from you.

Who in banker hell do you think you're fooling? I invite all victims of Well Fargo to give me their email addresses, or start a small website (just to collect names of other victims) we deffinitly have a class action law suit here, and these fake posters what you to think you don't. How sweet, they want the victim to think it is the victim's fault. Classic.

I'm not very familiar with the Ripoff Report workings. Please contact me. If there is no option for that, let me know if I can post my email here and I will return and do so in a lfollow up post below. In the mean time remove your money form Wells Fargo, close your account and join a credit union.

Warn people about Wells Fargo every chance you get. Let people know, forums, discussion boards, etc...

First of all, id like to say i can understand how banking fees can be frustrating. It can be really tough to see your hard earned money go out the window to fees.

Id like to address your first point, the bank does not "hold" your deposit nessesarily. Any check deposited in any financial institution that is a member of FDIC must go through Federal Reserve processing. This is not a decision made by the bank, this is mandated by the Federal Reserve Board. If a check is deposited before cut off time (varies from branch to branch) it will go through processing that night and be available for transactions the next business day at eight oclock AM, local time where you opened your account.

As to the second, the fact that wells fargo processes your largest items first. This is true, Wells Fargo does process the largest items first, as to ensure more important items, such as car loan, mortgage, and insurance paymnts are cleared first. This is mandated at the state level. This is true in every state except for New Mexico and Washington state, where state banking regulatory entities have ruled that the smallest items should be processed first.

If these items are seeming to frustrate you, I would suggest speaking with your state representative or congressman about them.

Lastly, id like to apologize if any Banker, teller, or phone representative from Wells Fargo has been rude to you, it's certainly not in line with the company ideals or standards set down, nor the sort of customer service i strive to provide.

Overdraft Charges

Overdraft charges are posted to the account the day AFTER the overdraft occurs. So if you are charged for an overdraft on a Tuesday, but you made a deposit on Tuesday, you missed the boat since the overdraft occurred on Monday. Further, if you have made the deposit on Monday, you'd still be charged since WF posts debits before credits at night.

These fees are the price you pay for writing checks before the money is in the account. You can play that game if you choose, but I can assure you that the bank plays it a whole lot better than you do.

Not a Rip Off

Wife, there is insufficient information from your post - however I sort of know how these things work. Essentially, the money is DD into your account on a Thursday evening from the reputable firm. However, the paycheck is dated on a Friday, which means the money IS NOT in your account Thursday evening. So if they hold your paycheck for one day, it means your money is available Friday - the day the paycheck was dated.

In other words, changing banks will simply have this problem follow you to the next bank, and the one after that when you get tired of that one.

I suspect your debit card is really the source of your problems. You haven't indicated you have one, but it is generally the #1 reason why people seriously overdraft their accounts. Many people don't understand tht in your account agreement, the debit card can often end up getting someone into serious financial trouble by (a) changing transactions to post from higher to lower and (b) causing all of one day's transactions to be hit with NSF charges, even if it was the last charge that caused the account to go negative. Stop using your debit card and get yourself a credit card. Keep an accurate check register and you should be fine even with Wells Fargo. Best of luck to you.
