WELLS FARGO MORTGAGE Wrongfull Foreclosure while in active Loan Modification Trial. Even though we had all acceptance papers and 1st payment sent, they mistakenly foreclosed on our home. We now trying to get rescinded. Wrongfull Foreclosure while in Active Loan Modification.West Des Moines Iowa

We were accepted to the Wells Fargo Loan Modification Plan under Pres. O'Bama's Home Affordable Refinance & Loan Modification Program on July 20th,2009. after working on qualifying and documentation (a Living Hell) for over 7 months.  When we started we were only 1 and 1/2 payments behind, because I had lost my company of 28 years as a Custom Home Builder due to this terrible down economy.  Finally all terms were accepted to the Loan Modification, all docs as agreed and the first payment was made to the program.

We were Foreclosed on Tuesday, August 4th, approximately 1 month into the program, and first payment made,with No notice or contact.  We found out about the foreclosure with a sticker on our front door by a Real Estate agent. We had just talked to WF on the July 31st the Friday before the FC and on Aug. 3rd, one day before FC and WF Loss Mitigation said not to worry we are on the HAMP program and Foreclosure was postponed.

Since the day after the FC, we have been trying to contact the right person to get the Foreclosure rescinded.  I have been on the phone an average of 4 to 6 hours since then trying to find someone who could correct this mistake.  Yes WF admitted it several times during my calls that it was wrongful and we had "just slipped through the cracks".  NO One we talked to could, nor would correct this mistake.  We tried and tried to find out who to talk to.  In the mean time my wife had to go to emergency to help the High Anxiety she was having, and we called several attorneys trying to get an answer of what to do.  All attorneys wanted Big Retainers to Begin.  We didn't have it!!  We were totally at a loss as to how or who to call next to get Help.

Help Arrived:  In my searches on the Internet I found Rip Off. Com and read a complaint against Wells Fargo, where they had listed the E-Mails, and titles of about 7 high-up executives, CEO, CFO, etc.  We wrote a letter (essential the same as this one) except far hotter than this, actually expecting  nothing to happen. Unbelievably, within 45 minutes we got a call from the Office of the President.

The lady that called, immediately apologized on behalf of Wells Fargo for our unfortunate circumstances regarding the foreclosure sale of our home.  She said she and all pertinent personnel were in the process of having the foreclosure sale rescinded and the approved HAMP loan modification program re-established.  She has promised to give us daily updates and feel free to call her at her private direct number.  She also sent us an e-mail verifying every thing she said.
