I had a vendor account with 2checkout.com for about three months. Everything was fine until one day they shut down my account for no reason. They claimed that one of the many domain names being used had been previously denied an account. This is after three full audits by them, including verifying and approving the domain in question to transact business.
Claiming a violation of terms of service, because the domain in question had been owned by a previous vendor, they proceeded to terminate the vendor account and keep over $25,000 of the money.
Apparently they feel that their terms of service allows them to just seize vendor funds legally earned and in compliance with the terms of service.
Now, if Paypal shuts down your account, six months later they will cut you a check for the account balance.
However, 2checkout refuses to pay me the account balance, citing this lame technicality as a TOS violation, and thinking they can just steal over $25,000 in hard-earned, legally-acquired income.

While we would of course like to clarify the specifics of this situation for the convenience of our customers and vendors, 2Checkout's privacy policy prevents us from releasing personal information in a public forum such as this.
2Checkout has been a Better Business Bureau Accredited business since August 2001, and we have submitted the details of the case to the BBB in response to Tara's complaint. The decision made by the BBB will be sufficient for us, following which we will take whatever additional action is warranted.

Hiding behind your terms of service does not justify outright theft.

The fact of the matter is that 2checkout found an excuse to shut down the account in order to pocket the monies paid through legitimate business transactions.
There was no fraud, no sales of illegal items, no violations of their terms of service.
The domains in question were evaluated three times by their auditing department and found to be in full compliance with their terms of service.
A singular domain out of the many domains used to transact had previously been used by another customer to apply for an account and was apparently declined. Because the previous domain owner had been declined, this has been used as an excuse to pretend that there was some sort of willful violation of their terms of service.
But the only thing willful violation here was willful intent of 2checkout to steal the funds owed.
If they truly believed there was a problem with any of the domains, they'd not have allowed over $70,000 in transactions to occur, but would have declined the account either upon application or upon the first audit.
Apparently, they figured they could just shut down the account and keep the money and I'd go away quietly. However, they are wrong.
I have filed BBB complaint. The Better Business Bureau should be very ashamed that one of their members is outright stealing funds from their vendors.
I have also hired a lawyer and will turn this into a major legal issue. Theft is illegal, and them hiding behind some obscure mumbo jumbo will not help them if this goes to court.
Paypal has lost many lawsuits trying to steal funds from customers as 2checkout has done to me. There is much legal precedence. I will turn this into a class action if I have to.
Not to mention, they are probably in violation of Visa and Mastercard regulations. Perhaps suing Visa and Mastercard will apply the pressure necessary to convince 2Checkout to do the right thing and return the funds they owe.
I'm sure other customers of 2Checkout will be unhappy to hear that for any reason at any time, 2Checkout can simply dip their hands into their funds and keep them for themselves. That they can just change their legalese anytime they want to determine that someone is "in violation" of their TOS and then keep that vendor's funds.
I think that these thefts done by this unethical company have only gone unnoticed because the others they've stolen from have been too small dollar amounts for anyone to make a legal issue out of it.
But this time it is different, they have stolen over $25,000 and the issue is not going to get put to rest.
One way or another, 2checkout will either pay me the money they stole or be in for a serious legal battle that may very well put their ability to remain in business at risk.
2Checkout's behavior is illegal, unethical, and immoral, and it needs to stop. I am not giving up.
