The CEO of Air Parcel Express has all of the documents, which were sent by email to me from Penta Maritime Agencies Ltd.  I have a least 50 documents, which support what I am stating.  I have included in this article four photographs that were taken when the cargo container was opened in Riga, Latvia, which is not apart of Russia! Latvia is a separate country.  The service by the Russia people in getting my cargo from Moscow to Belgorod was better then what Air Parcel Express has provided in getting my cargo to Russia in the first place. 

The photographs show that my cargo was damage before it got to Riga.

I personally delivered my cargo to Conterm C/O Safepak, 400 Littlefield Ave, South San Francisco, and watched the forklift driver unload and stack my crates.  There was no damage to my crates at this time.

The Statement that the CEO makes on my last post to the Rip off Report Shipment arrived via Riga in good order is fraud in fact - actual deceit; concealing something or making a false representation with an evil intent to cause injury to another.  Air Parcel Express was sent all of the information that I have from this trip along with photographs of the damage.

With ref. to your msg.herebelow please be informed:

 

1. Pls see attached the pictures that state the cargo condition when the container is opened in Riga.

So the packages were already damaged when arrived.

 

2.  Shipping documensts always state :

""Shipper''s load, stow and count"

 

So, the claim should be addressed to the shipper / forwarder

Hello Marita,

I got to inspect my crates yesterday before they were put on another truck to Belgorod.

Crate #4 was severally damaged.  The side of the crate was crack opened and the lid of the crate, which was lock with pad locks, was completely broken.  Someone used shrink-wrap to hold the lid onto the toolbox.

Ivan your truck driver mentioned that he was not around when the crates were loaded.  He stated to Natasha that crate #4 was damaged before my crates were un-loaded from his truck.

The storage manager at customs also has stated that crate #4 had been damaged before it was unloaded from Ivans truck.

Where was this crate damaged?

Please email me the copies that you have from APX stating the Port of Discharge!

Please note that Port of Discharge is different from destination of cargo!

My delivery is to be made at customs in "????????? ?????????? ????".  My crates were not to be delivered to Riga in the first place! 

Customs in Moscow is aware that I want to go through customs in Moscow.

I will be in Moscow on Monday morning to talk with Customs.  I do not agree to anything at this point.  You have been paid in full.  APX and your company will be sued if I have any more difficulties with getting my crates!

I have already canceled my train tickets to St. Petersburg.  Now you are telling me that my crates will not be in Moscow on Monday after I just purchased tickets today to Moscow.

Marita made the suggestion to pick up my crates at "????????? ?????????? ????".

I believe that I have already paid you to unload my crates and if my crates came by ship to the port of St. Petersburg it would been at customs to begin with.

So your company now needs to take responsibility for the mistake that was made when shipment was made to the wrong country in the first place.  I have tried to contact APX and have gotten no response.  You should have your own forklift to unload my crates at customs.  After customs is finished with their inspection I will have a forklift ready to load my cargo onto another truck.

The Driver can contact us at the following phone number in Moscow on Monday after 6am

1) Our terms of Bill of Lading are posted http://www.shipping-worldwide.com/carrier.htm and shipper agreed to these. 

 
2) Insurance was issued for cargo and all disclosure pertaining to such was communicated to client ... http://www.shipping-worldwide.com/insurance.htm
 
3) Cargo arrived at final port as contracted for - No Fraud - If this is a formal complaint I invite the shipper to take it up with the FMC Federal Maritime Commission.  We are doing the right thing by mitigating his complaint with our CO-Loader "Conterm" who omitted the trans-loading point "Riga" as the ON-FORWARDING port that services St. Petersburg.
 
4) This part of the world is difficult AT BEST!! and we are proud of our service and track record.  We do not practice deception! ... on the contrary we try to be as transparent as possible as we know that TRUTH IS POWER.
 
5) Would the shipper place a claim to the INSURANCE COMPANY?  Did he follow procedure as stipulated on the insurance certificate or did he act without regard to process?
 
6) This file is still active ... and we will follow through to see if ANYTHING can be done.
 
7) The file is being reviewed by the ERRORS and OMISSIONS Policy we carry through our lawyer who will advise as to the final determination and we will inform the shipper.
 
8) The outlandish claims by the shipper are unsubstantiated.  At no time did APX have physical possession of cargo. It was routed from the receiving dock to the container then to the rail ramp and then to the loading port in the east coast.  From there the container landed in RIGA where it was de-consolidated and then routed to St. Petersburg.  The cargo had some damage but to this date the shipper has not made a formal claim to the insurance company.

METHODS AND ROUTES OF TRANSPORTATION. With respect to the Goods or Containers or other packages, the Carrier may at any time and without notice to the Merchant:

a) use any means of transport (water, land and/or air) or storage whatsoever;

b) forward, transship or retain on board or carry on another vessel or conveyance or by any other means of transport than that named on the reverse side hereof;

c) carry Goods on or under deck at its option;

d) proceed by any route in its sole and absolute discretion and whether the nearest, most direct, customary or advertised route or in or out of geographical rotation;

e) proceed to or stay at any place whatsoever once or more often and in any order or omit calling at any port, whether scheduled or not;

f) store, vanned or devanned, at any place whatsoever, ashore or afloat, in the open or covered;

g) proceed with or without pilots;

h) carry livestock, contraband, explosives, munitions, warlike stores, dangerous or hazardous goods or goods of any and all kinds;

i) drydock or stop at any unscheduled or unadvertised port for bunkers, repairs or for any purpose whatsoever;

j) discharge and require the Merchant to take delivery, vanned or devanned;

k) comply with any orders, directions or recommendations given by any government or authority or by any person or body acting or purporting to act with the authority of any

    government or authority or having under the terms of the insurance on the Vessel or other conveyance employed by the Carrier the right to give such orders, directions or recommendations.

l) take any other steps or precautions as may appear reasonable to the Carrier under the circumstances.

The liberties set out in subdivisions a) through l) may be invoked for any purpose whatsoever even if not connected with the Carriage covered by this Bill of Lading, and any

action taken or omitted to be taken, and any delay arising therefrom, shall be deemed to be within the contractual and contemplated Carriage and not be an unreasonable deviation.

In no circumstance whatsoever shall the Carrier be liable for direct, indirect or consequential loss or damage caused by delay.

First findings point that your claim is less than $500 worth of damage to property.  Your deductible is $500.  APX will pay $100 as face value of our policy.  More to come based on final review of your destination charges invoice.
