For several weeks now I have had repeated daily ( several times a day ) computer generated calls to my home.
The message always states that this is urgent and very important.
On one occasion an actual human being with a garbled and incoherent name and an equally incoherent bellicose manner asked for someone we have never heard of. We said we didn't know such a name , and that we are not that person ; but the calls continue.
So I did research on the phone number they left this evening in one of their , "this is an emergency" calls and I find they are a collection agency.
I have no debt and never did have any debt. I am not the chump they are looking for , and their chimp who can't speak english worth a wooden nickel is about to hear from the states attorney general of Wisconsin.

Could it be that THEY read this publication? And know they are beat ?

It makes no difference if the debt is yours or not. You still have the same right under the FDCPA to request a CEASE COMMUNICATION.

Then when they ignore your request that was sent by the means specified earlier, you sue them as per the provisions of the FDCPA.

Then, if they sue you for this debt, you countersue them for a frivolous lawsuit. Once again, you get paid!

Don't get mad. GET PAID!

Thanks to those offering very constructive help to my problem with Allied.

I begin by saying again , we have no debt , had no debts.

Another credit company ( a couple of years ago ) went after us because my wifes name matched a name they had searched for and they latched onto us and were extremely offensive and laughed when we said we were not the party they wanted. The Wisconsin AG took care of the matter for me and got the Company off my back. It was not easy , the A.G. had a lot of work to do , but it worked.

I want to bring as much force to bear as I can on these crooks because they are clearly willing to be as offensive ,mean and lawbreaking as they can be in order to get "their" money. They are basically thieves and con artists since they want me to pay someone elses debt.

We need to stand legally against these kinds of companies and with legislative support on a national level put them out of business.

By using the the AG the company is warned that our telephony laws are real and there is a fine for calling parties on the no call list.
Also , persistent threats , bullying and et cetera will not be tolerated by innocent consumers.


As of Friday last I informed the AG office and shall , as suggested above , write letters to the company involved. I shall report the outcome here.

You should direct all future correspondence in writing as outlined in the Fair Debt Collection Practices Act (FDCPA) and to cease all communication with me by telephone.

Lastly, I would like to receive confirmation in writing that you have received this letter and will no longer be contacting me about this other person's debt, or I will be forced to seek further legal action.

I look forward to your acknowledgement that you have received this notice by [date that is two weeks from date of letter].

Len,

First of all, the AG has no jurisdiction over debt collectors, the FTC does. Second, neither agency does individual enforcement. The FTC will only respond with a form letter explaining your rights under the FDCPA and the AG may write a letter on your behalf, but that's it.

All you have to do as per the provisions of the FDCPA is to send a CEASE COMMUNICATIONS request.

In this letter clearly dispute the debt and explain that you are not the person they are looking for. Then give them the number that they are calling and inform them that all calls will stop immediately, or they will get sued for the blatant FDCPA violation.

Do not sign the letter. Just print.

Send this letter by certified mail, return reciept requested, and be sure to put the certified# on the letter itself and keep a copy for your records. This procedure is very important.

Now, if you get any more calls past the date the little green card was signed, you file a lawsuit for the violation.

Don't get mad, GET PAID!
