On June 23, 2007, we hired Always Perfect Studios Photography for photography services for our wedding in November 2007 in NY. We paid a $2,929.66 fee in three payments of $976.55, $976.55, and $976.56 on June 23, 2007, October 1, 2007, and November 1, 2007 for the services.
Their photographer named Peter was at our wedding and took our photographs. On January 8, 2008, we received a CD containing the digital proofs from the wedding. Unfortunately, the CD was missing a large number of invaluable photographs. For example, there are no (zero) photographs of us at our ceremony and every family portrait Peter took during our cocktail hour for 90+ minutes is not included.
We sent a certified letter, return receipt to their office which was delivered the week of January 21, 2008. We were inclined to send this letter as we made no progress in rectifying this matter after numerous phone calls to their office. This letter informed Always Perfect: a) that we expect an immediate call back to let us know when Always Perfect intends to supply us with a complete set of our wedding photographs, and b) to let Always Perfect know we are unable to meet their 90 day from date of affair deadline for placing an album / physical photograph order as Always Perfect had not yet provided us a complete set of our wedding photographs.
On Wednesday January 23, 2008, my wife and I spoke to Sam from their office in two independent phone conversations. Sam informed us that Always Perfects cameras memory card malfunctioned during our wedding, the memory card the camera utilized was mailed back to the manufacturer, and the manufacturer stated they were unable to retrieve the complete set of photographs.
Sam informed us during this phone conversation that Always Perfect would be willing to:
a) Take new family photographs the next time we were in New York (we live in North Carolina today), and
b) Create albums using digital photographs our guests took at the wedding, as long as we requested all of our guests send us the photographs electronically.
Our view is Always Perfects proposal is unacceptable. There are multiple reasons for this, including the fact that we had relatives that flew in from multiple U.S. locations for our wedding and it would not be possible to gather the entire family for Always Perfect to re-take our wedding photographs at any reasonable date. Additionally the photographs our guests took using their own digital cameras are not of the same quality level we expect from a professional photographer.
On January 27, 2008, we sent Always Perfect Studios a second letter certified return receipt highlighting our formal response to their proposal which was delivered on January 30, 2008. We believe Always Perfect was grossly negligent in allowing this situation to occur. Their photographer could have easily tested the primary camera & memory card in advance of our wedding to mitigate the possibility of this situation occurring. Their photographers, according to their website, always have backup equipment available in case of equipment malfunction. Why wasnt it used? The gross negligence by their company at our wedding caused irreparable, lifelong damage to us and our families and is not rectifiable.
Due to this situation, we requested a full, 100% refund of the $2,929.66 fee we paid. We requested the refund and a formal response USPS certified return receipt or via trackable means by February 11, 2008. We called their office on February 13, 2008 and spoke to Sam again, as we did not receive a formal response. He was apologetic and could not understand why we had not received a call or formal response. I informed Sam that unless I heard back from an appropriate decision maker at the company by February 15, 2008, I would file formal complaints both online and via the local authorities. Unfortunately, we have did not hear back from their company today, February 15, 2008. All we want is a refund!
