My wife and I entered into an agreement with APFS in October of 2009. I had lost my job in September, and we knew it was going to be hard to make house payments. So we entered into an agreement where APFS was to negotiate a deal between us and Bank of America for a home loan modification. After entering into a contract, we filled out about 50 papers, and faxed them in. We felt like we were making the write decision.

In January, we got our first "acceleration of note" notice. Intent to Foreclose.

In February, B of A contacted us directly, and requested documents. They sent us a big box of paperwork to fill out. We contact APFS - Daniel Kelly, and asked what we should do. His first response was to ignore them. The very next day, we called and asked about that decision. He then requested we fax over the documents so he could see what B of A was requesting. After doing so, Daniel Kelly contacted us, asked us to fill out these documents, and fax them to him. He would then pass that on to the negotiator.

On March 29th, B of A contacted us to let us know that we did not qualify for the home modification load. B of A further explained that they had requested documents back in Feburary, but APFS representative Jack Hefner. Did not return the documents in time.

We are currently 2 months behind on our house payment, soon to be 3. As of this writing, I am still waiting to find out exactly who is dropping the ball here. Although at this time, I cannot call APFS a scam, I am very, very concerned. We are going on our 7th months of this home-mod program, and we have yet to receive even one offer to reduce our house payment.

I will keep this post update...and hope for a pleasant outcome.
