After hurricanes Wilma and Katrina, our mortage company (ASC) offered to help by giving a three month reprieve on payments. They told us we didn't need to make a payment until February of this year. In february we again started making our normal payment.
Now they have sent us a letter stating our loan is in default as of March 1st. and we must pay the entire amount in arrears (+/$7,000) immediately or they will begin foreclosure proceedings.
It's an outrage to expect we can pay this and a scam to have told us due to the hardship of the hurricane we could skip payments until february just to pounce on us.
our property is suddenly in a precarious position.
Please help!
Have other people finding themselves in this position.

#2 UPDATE EX-employee responds
ASC not a ripoff.

I would first like to say that my heart goes out to you and your family for everything you have been through, but, I do belive it has been more then a missunderstanding.
I use to work for that company, and I still know several employees who work there. When they tell you about not having to make a payment for 3 months, they never tell you that you never have to make those 3 payments up.
They tell you that you are not being forgiven for those 3 months, they just will not report you late on your credit report, and will not start any collection activity, but on the fourth month you will owe for 4 payments. I just believe that you got excited about hearing about no payment for 3 months, and tuned everything else out.

Victor,
Listen, I know how you feeling.
Immediately, look up and call to several commuity agencies and get some info who can help with a pro bono lawyer. Also call your local attorney referral service. Don't wait another day. Begin call ASAP. They are agencies that will help with a lawyer for free or a sliding scale fee. Also, contact some big class action lawyers and see if one of their attorney's will do it pro bono. There lawyers who will. I know for instance where I live, there are several differenct associations, such as La Raza Lawyers Association who will offer services free. You're going to have to be proactive and really hustle, but you can find someone who will help. Also try calling community foundations. They can help direct your. I would also suggest you go on line to (I think it's) www.acorn.org.
I hope this helps.
