Before finding this web-site I didn't know whom to contact but this is my story:

My mortgage company ASC wrote me and said they had not received my May 2005 payment and they wanted the canceled check. I am ill and Social Services paid $300.00 and my sister wrote them a check for 138.95 for the difference including the $20.00 late fee.

Then they wrote and said they received the May 2005 payment, but the June 2005 they had not received. For the June payment Social Services wrote a check to them for $300.00 and my daughter wrote a check for $117.95.

Then for July 2005 I received a bill from ASC for $2,000.00. Being very ill and not thinking very well at all I called the mortgage company (ASC) and I was told by a person in customer service that they don't have time to process these partial checks and she hung up on me.

I then said to myself they will get straight and send me the right bill, but to my surprise for August 2005 ASC sent me a bill for $2,500.00. Still very ill I said to myself they are going to get this straight and send me a correct bill.

Then For September 2005 ASC sent me a bill for $1,795.00. Upset I advised my daughter to send ASC a check for $1,795.00 and I wrote on the statement July, August, September and October 2005 payments. You see I was past due for July and August, Late for September, but paying October 2005 in advance. I have Copies of Bill and check payment, and the date on back of check as to when ASC received it. It is before the 16th of October 2005 with the correct amount due, but the months are for July, Aug, Sept, and October; because June payment had already been received.

To my surprise ASC held my daughter's check and knocking at my door was a man serving me with court foreclosure papers. I called ASC and was told by a customer service Rep. to mail back the check and I would not be charged with lawyer's fees. Which I did.

Then in November 2005 I was told by lost litigations that they must receive about $1,200.00 within 4 days. I knew this was a mistake, but I did just to get my home out of foreclosure and be able to discuss this misunderstanding at a later date. I also mailed November 2005 regular payment Quick Pay to them.

After this ASC informed me that foreclosure has been suspended, but they will only inform me verbally and will not give me anything in writing. Also during the verbal conversations ASC informed me they had posted the June 2005 payment and it was received after I sent them the canceled checks from Social Service. Meanwhile during all of this stress I was rushed to the hospital by EMS to Bayfront Hospital for chest pain. I was given nitroglycerin by the paramedics. I was in the hospital for 2 days before released.

Then I called in December 2005 to make my December payment and I was told "you owe for December 2005 and January 2006. I asked how can I owe for January when its still the month of December. All in all I told them I only have December 2005 payment and they took that over the phone.

When I called in January 2006 to make my January payment I was told you are placed back into foreclosure. You owe January and $300.00. I said how do I owe $300.00 and they state would you like to talk to someone in lost litigations. I said yes. When Lost Litigations examined the file they stated I was placed there again by misstate and they would notify the person (Andre) of his mistake, but I still owe $300.00. I asked how? Then I told the person I have only my mortgage payment at this time and if I could pay this and not be placed in foreclosure until someone straightens this out. I was told yes I could and they would not be place into foreclosure because it's such a small amount.

Following up I call Andre, in lost litigations and he stated he will get in touch with the lawyer and take me out of foreclosure to give him and call on Monday. I called him Monday, Tuesday and Friday he has not to date returned my call. I then call ASC customer service, lost litigations and both departments stated I am in foreclosure. I call their lawyer and he stated he only does what they tell him and I will be receiving a letter stating I am in foreclosure.

UpDate:

Today I received a letter from ASC stating:
Effective October 1, 2006 my mortgage interest rate change date for my loan is September 1, 2006, with a new payment adjested from $417.95 to $528.14. The next adjustment will occur in 6 months.

The current index value was published on 8/1/06. This is the selected index value for the index known as "6 MONTH LIBOR PUBLISHED IN THE WALL STREET JOURNAL". yOUR INTEREST RATE WILL BE ADUSTED FROM 9.37500% TO 12.37500%.
