Aspire has changed our billing dates several times. My husband is active duty military and has automatic payments set up. He cannot call from Iraq to verify that payments are received on time so he depends on me to do that.
While reviewing his account, I noticed that he is being charged late fees BEFORE the due date. His account is current and has no past due charges. Our most recent statement shows that the due date was Sept 9, our payment was received electronically on Sept 6, and we were charged a late fee on Sept 1st.
I called customer service because the EXACT same thing happened for August and we were supposed to have that credited back to our account. They did not credit us and charged us another $35 late in late fees.
When I called, the customer service person said I could not request anything to be done on the account since it is my husband's account. I told them I WAS authorized for everything (have to go through this every time) and that they WOULD help me. I spoke to a manager at that point and she said it was MY fault we were being charged the late fees. I told her that we were charged PRIOR to the due date and she said, (this is great!) "You need to send in your payments at least 4 days before the due date." I responded with the same statement that the due date had not even passed when we were charged the late fee.
She said that she could not remove the fees because we had a credit of a late fee in July (when they did the SAME thing).
I have the written proof. Anyone know what sort of legal action I can take on this?

You have access to free legal services in the military. Take advantage of them. Have them right a letter regarding these bogus fees. FYI: Aspire is nothing but a scam. they constantly prey on customers for all sorts of late fees. If you get this issue resolved another one will invariably pop up. Pay off and close the account ASAP.
