I was visiting my friend at an apartment complex and got towed. Called assured towing and stated it was in the lease"no illegal parking" stated sign at entrance, stated parking spots marked tenants and visitors. The only thing this lying Andrew said that was true was the sign at the entrance.

No parking spots are marked as tenant or visitor. Lease states guest can stay parked no longer than 7 days, I was there no more that 45 min.. They Will not give car back. They have contracts with apartment complexes and Andrew admitted to "towing at random." Police called, manager of apartment complex is confused and doesn't know how to handle the mess she created. 7 on your side and keye notified of the stealing tow truck company.
Petition stated at apartment complex. Our goal, Andrew fired, apartment manager fired, will be all over the news, car returned with an appology.

Spoke to Les Juliano- owner of Assured towing, he told me i could go with a friend and have her show her i.d. so i can get in my car, but last night the before mentioned Andrew said i could not get in my car because i did not have my i.d. and i had to go and get this letter noterized but i caint even do that w/ out my i.d.

i called the appartment's management company. they admitted to my car being towed as an illegal towing but said i had to go to the apartment's manager. i went to her and she would not help me at all. i am not the only person who has had this happen to. numerous people have had the same thing happen even people who have stickers who live there. even the apartment manager's car has been towed.

What is this guy, "Pat", talking about? For real!! Noone ever mentioned anything about installing signs or giving signs to this property. What usefull information is this towards this case of the alledged towing misconduct and the unsatisfactory of customer service by this towing company. And if I take his advise with respect and read the Texas Transportation Code Chapter 684, it also states that all owners and operators of vehicles will obey these laws as well, not just the tow people, HMMM, why did he not mention that?

He says: "Towing companies that perform private property towing KNOW the public is familar with State Law and take advantage more than you think."

Then Pat says: "Towing companies count on you not knowing the Law."

WHAT!?!?? He just contradicted himself.

Police from ANY city would investigate an illegal ANYTHING. If this vehicle was an "illegal tow" as supposedly stated by the management of this apartment complex, "Aubry Apartments", then why did they not call the towing company themselves and demand the vehicle back immedietely and then contact the police department to report this as Auto Theft?

Look, I have been towed twice before. Yea, twice! Guess what? Both times were my fault. Once I did not even look for the signs when I went to visit a friend and the other i just simply ignored it thinking it would be ok anyway. I was wrong BOTH times. I think this person went on this property to visit a friend. She either ignored the sign or just did not think about it at all when she entered the property, talking on the phone, that type of thing. She parked and then got towed.

I see this in a whole new direction:
1. The friend she went to visit KNEW about the rules and irresponsibly did not inform the friend of the rules and where to park. This puts the blame on the friend being visited.
2. The manager of that complex did not want to "Deal" with the problem at that time and told this person what they wanted to hear for the moment. If it had been differently, the police would have been involved along time ago. The manager should have supported the rules of parking he or she may have implimented on this property and the arrangement he or she made with the towing company. There was a deal for towing, I can almost guarentee that. This person admits that there was a "contract". If there is a contract, there is no illegal towing. The police even stated that the manager of this apartment does not know how to clean up the mess she created.
3. There was a sign at the entrance. This person admits that, If you read the Texas Transportation Code Chapter 684, as described by our very own "Pat", it states that the only signs required is the sign at the entrance of the property. Therfore, there is no illegal towing.
4. This Andrew, whom I would have to guess is a customer rep for this towing company, should not have been more up to speed on the layout of this property and to what signs are actually there, other than the entrance sign, which has already been stated to have been there. It is the towing companies responsibility to train himproperly in this fashion. Other than that, I do not see why he should be demanded to be fired. It was not stated that he was rude or violent in any verbal manner. He did not let this person get inside of a vehicle that that person could not prove was hers or his. I would not want anyone gaining access to my vehicle just because they said it was so, without at least showing some sort of proof. In fact, I would be furious if that had ever happened. I think this Andrew did the right thing at that moment.
5. If this had been anything credible, Fox 7 On Your Side would have been all over it. They did nothing obviously.
6. The apartment managers car was towed?!? Please! You know that if that ever happened, that towing company would have never been there to begin with. Let's get this straight, It is the apartment manager that makes the shots at this complex and it is the apartment manager that will allow or disallow any activity on his or her property. I know, my girlfriend is an apartment manager.
7. The owner of this company, Les Juliano, gave the ok for this person to gain access to his or her vehicle. I would not have done so, as I had previously stated, but it sound s like he went out of his way to diffuse the situatuion by allowing this person to get around the normal procedures to gain this access.

This whole thing has been made to look like the towing company was completely and absolutely the cause of this whole fiasco. The opposite seems to be true here. This drama. and I mean DRAMA, seems to have started with an inept manager with no backbone to back up her own rules and enforcement of those rules, a lazy operator of the towed vehicle who made spilled milk seem like the flooding of the world and Noah's Ark and such forth, a unfreindly and uncaring friend that allowed this person to get towed from the aprtments that he or she lives at and DOES know the rules of, an unifmormed customer rep of a towing company and an owner of a towing company who was pulled into a mess he did not create.

Final Verdict:
It was not the towing company that was at fault in any way here. In fact, it sounds like they performed their job well and towed what they had been contracted to do so. I did not hear of any damages to any vehicle and did not hear about any rude behaviour. Bravo, better than most towing companies by fae so far.

The manager was the ultimate guilty party here. This person is responsible for the rules and enforcement of those rules, and ANY actions that may arise out of them.

As the line goes; In War, Do Not Blame The Soldier; Blame The Politician!

The Soldier is the towing company. The Politician is the apartment manager.

Texas Towing Statute

The parking facility is required to be compliance before any vehicle may be towed.

The towing company is prohibited from installing any signage or giving anything to the parking facility manager.

Texas Transportation Code Chapter 684 is the regulations that parking facilities MUST OBEY.

Restricted parking spaces MUST be marked in the front and rear of a space and cannot be any higher than 7' off the ground.

Vehicle owner or operator is entitled to 3 times plus $300 and reasonalble attorney fees for whatever they pay to retrieve their vehicle.

If the sign is not in the required locations and contain all the text, the vehicle is illegally towed.

Towing companies that perform private property towing KNOW the public is familar with State Law and take advantage more than you think.

In Austin, the vehicle owner or operator can call the POLICE and file a report for an illegal tow, which will be investigated.

If the parking facility is not in compliance, criminal charges are filed only after the victim gives a written statement.

The fee you paid will be mandated by the Court.

The Tow company is simply following the contract that they have with the Complex. Trespass towing is done "at random" precisely to catch illegal parkers, say every fifteen minutes or so. This is because the renters and management want it that way. The person you were visiting should have warned you about the rules, but chose not to bother. As far as the ID requirement, it's the law. They CAN'T release the car to anyone but the legal owner or their authorized agent. Otherwise car thieves, repo men, ex-husbands, etc. would be picking up cars all the time, leaving the towers holding the bag.
