Auction Road ripoff I want my refund! Goleta California

I ordered this service on 7/22 which it was told to me then that it was a monthly cost of 9.95 and I had a 30 moneyback guarantee. The next day I did some more research on action roads website and found that the products they offered were overpriced and would not sell on ebay.

I called on 7/25 to ask for a refund, but I had also found out on this date that my bank account was billed 89.55 and 9.35 from Auction Road. When I called to ask why i was billed this they said we bill for 9 months and plus shipping and handling. I then said well I want to cancel the service because one I was not told I would be billed for 9 months and two I dont like the services. I was told then I would have to wait for my welcome package and they would research my phone conversation and call me back.

on 07/29 a supervisor #634 gave me call back. She played back my phone conversation to me. There was a loud click in the middle of the phone conversation and another persons voice came on and was then explaining about the 9 month billing. The supervisor said not to worry just wait for my package and return and I would get my refund.

8/1 called because I hadn't received the package yet. I was told then that all mailing on 07/22 were not shipped out and that a package would be shipped out to me that day. I told them not to because I didn't want it just to give me the refund, they said no they had to send it.

8/4 I recieve a letter size (8 1/2 x 11) envelope from Auction Road, mind you this thing supposably cost 9.35 for shipping and handling. I sent it back UPS so I could track it on 8/5.

called 8/13 they said they hadnt got it back yet, but ups tracker showed they did, they said that it was probably sitting on someones desk waiting to process.

8/18 called and they said they had received and my request for a refund would be processed within 7-10 business days.

9/12 called because still no refund. Operator #626 said that the request for refund was there, but the request to process was not so he would put it in and in 3-5 business days I would receive it.

9/22 called still no refund, was automatically transfered to a supervisor #634. She advised that they were no longer able to process refunds that their credit machines were broken and that's why I hadnt received my refund, and if I wanted one I would have to call my bank and get the refund from my bank.

So I now have a credit disput going with my bank, but they cannot refund me the money, unless action road refunds it to them. Which I dont believe will ever happen. My bank told me the next step if they dont refund the money to the bank for me is small claims court and I just keep thinking it is on 89.55 that's a small amount to go to court on, but I know I am not the only one out there.
