Bank of America has a nice little scam going with their NSF fees. They are re-arranging transactions to make a profit at the cost of the consumers. They need to be stopped, they are hurting the families that are living from paycheck to paycheck. When I go to my online banking I am charged NSF fees even when my account is not in the negative. I have had an account with them for almost three years and they have managed to take a couple of thousand dollars in NSF fees.

If I am overdrawn by $80.00 they will charge me $245.00 in NSF fees. Instead of not paying one item of $100.00 they will gladly pay it but they will re-arrange the items from largest to smallest making them get $245.00 in NSF fess instead of just the $35.00.

In my eyes this is excessive and should not be allowed.

I think some of you miss the point. Sometimes you can not avoid it. You have to have a roof over your head and lights so you pay both in hopes you can get your paycheck in before they clear. I take it the person with the comment isnt one of those people so dont commeent on things you know nothing about. I'd say I'm amazing with money but it has happened twice to me where tuition and rent cleared at the same time and I went over by $20 because I forgot I post dated a check to my dentist. It happens. And when they say rearrange payments they mean they clear large amounts of money in the begining to get you as low as possible and then clear 5 and 6 dollar crap to hit you with NSF fees when your overdrawn even when they are days apart. I have a small credit union now and they have never givin me an issue unless it was fault of my own and eveen then they take take of it. And you say they have never agreed to loan us money yet that is what we put our money in the bank for. Our savings is a loan to the bank that they use. And I can almost swear nobody agreed to give B OF A a massive bailout but what do I know right?

BofA alleged NSF Scam

I have never been employed by BofA, but have been an account holder with BofA (prior Fleet Bank) for the past 11 yrs. What those who complain about the NSF charges do not seem to understand, BofA is just the medium by which money is being transferred (in this case via a check) from one party to another. Nowhere did the Bank agree to lend the check writer any money (unless he/she has overdraft protection which seems unlikely as the writer appears to have no credit), hence the NSF charges. Regardless of how the Bank handles the daily transactions, from largest amount to smallest amount or in reverse, DO NOT ISSUE A CHECK UNLESS YOU HAVE THE MONEY FREE AND CLEAR IN YOUR ACCOUNT. In most States issuing a check which is not covered is a crime, in some states even a felony. To the person who wrote that it is sometimes necessary to issue a bad check NONSENSE. These are all signs that the person writing the check is spending money he/she does not have free and clear at their disposal at the time they are issuing the check. What difference does it make when the bank knows ACH funds will become available? The issue is, the funds are available to the check writer only on the day when they are supposed to be. If the Payday is on Friday, then the funds will be available on Friday, regardless as to when the payroll was deposited with BofA. All other arguments are veiled excuses for having spent money not available. A simple test is: are the funds free and clear on the date/day they should be? If not, the Bank is in violation of Regulatory Laws under which it operates and the account holder has recourse. In ten plus years, not a single employee has ever not had his wages direct deposited into his/her account on the day they were due. Our Payday is on Friday. Sometimes the paychecks are already available to the employees on Thursday. If this is the case, the employee should be happy, but he/she better not count on it.

It is no secret that BofA makes its revenue from their fees. It is therefore suggested you open an account with a small local Credit Union which is still somewhat behind in their automation, however Rule 21 NO FLOAT is the rule with almost all financial institutions.

SO WHY DON'T WE ALL BE HONEST the current economy is poor and those who live from paycheck to paycheck are even more squeezed. However learn not to issue checks before they are covered. If you are already squeezed you can't afford paying the NSF fees, but you will, as you have no control over them. If you can pay the NSF charges, which you will and do, you can manage your money better to avoid them.

Final suggestion do not use the excuse that the bank is screwing up your account with people who are knowledgeable about banking. They will immediately see your problem and you look foolish. Work on getting OD protection from your bank. Either with a secured deposit or via credit from the bank. If this is not possible create your own OD protection by depositing weekly an extra $10.00 into your checking account and do not use the extra money. Do you have the discipline? Do not tell me you can't, as you were able to pay the bank all the imposed NSF fees. If you had the money for the fees, you have the money for establishing your own OD protection.

Writing checks

and debits with not enough money to cover them is not allowed, yet you still do it. It is illegal to pass a bad check. For someone that allegedly lives paycheck to paycheck, you certainly are irresponsible in not keeping an accurate register to avoid the fees.
